Ethics Panel Scorches Drug Court Judge

ATLANTA (CN) - Georgia's judicial ethics board filed misconduct charges against the head of the state's largest drug court. The Commission on Judicial Qualifications accused Glynn County Superior Court Chief Judge Amanda Williams of "tyrannical partiality," making false statements, indefinitely incarcerating defendants, abusing court visitors and defendants, and nepotism.

The 12-count Notice of Formal Proceedings caps a long investigation by the Judicial Qualifications Commission, made up of state-appointed investigators and attorneys, with former Georgia Supreme Court Justice Leah Ward Sears and former state Attorney General Michael Bowers as lead prosecutors on this case.

The Judicial Qualifications Commission (JQC) already was investigating Williams when a March 2011 report from National Public Radio's "This American Life" brought some of Williams' behavior on the bench into the public spotlight.

Program host Ira Glass focused on the story of defendant Lindsey Dills, a repeat drug offender with a history of suicidal behavior whom Williams incarcerated for an indefinite jail term. Glass also reported on other cases in Judge Williams' court.

Drug Court, an alternative for repeat drug offenders, allows a defendant the chance to enter a county rehab drug education program, instead of doing hard time in jail.

According to the JQC complaint, Dills originally was charged with forging her parents' checks in 2005 and under the terms of her sentence entered into a drug court contract. When she violated the contract in 2008, Williams sentenced her to a 28-day prison sentence. According to the JQC's 31-page complaint, Williams knew Dills was suicidal.

"Despite her history, on or about October 8, 2008, you held in chambers and outside the presence of the public and a court reporter, a hearing at which you sanctioned Dills to 28 days in custody for 'violation of [her] drug court contract,'" the JQC complaint states.

It continues: "However, on or about October 8, 2008, after Dills was taken into custody and transported to jail, you sua sponte modified her 28-day sentence to a period of confinement 'indefinitely' in the Glynn County Jail and 'until further order of the court.'

"Furthermore, on or about October 8, 2008, after Dills had been sentenced and transported to jail, and you returned to the courtroom and gave verbal directives to personnel and/or court officers, to wit: 'On Lindsey Dills, she is not to have any telephone privileges and no one is to contact or visit her except Gail Kelly! Nobody! Total restriction!'

Dills was held for 73 days, during which "No one, including either Dills' drug counselor or her attorney, visited her," the complaint states.

She tried to kill herself on Dec. 9, "while in solitary and restrictive confinement," but even "(a)fter this suicide attempt, Dills remained on court-ordered lock-down until about December 22, 2008, when she was subsequently transferred to an inpatient treatment facility," the complaint states.

It continues: "At the time you ordered Dills into indefinite, restrictive custody, you knew or should have known that Dills was predisposed to suicidal tendencies, having previously signed an order placing her on a suicide-watch while she was in custody.

"When queried, you and/or your legal counsel, on your behalf, knowingly denied that you ordered any defendant at any time to be held in restricted custody, solitary confinement, or otherwise directed the conditions by which an inmate should be housed."

The JQC report says that Dills is not the only drug court defendant Walker ordered to be incarcerated indefinitely.

In another case, Williams jailed a defendant for more than 17 days for disputing his drug screening test, JQC says. Defendant Charlie McCullough was 3 months away from graduating from the drug court program, when he failed a random drug screening.

Upon request, McCullough took the same test within 20 minutes of the first, and his test was negative. A third test came out negative as well, according to the complaint.

The JQC says: "The drug counselor advised McCullough that he would be required to appear in court because of the result of the first drug test. Although he passed both the second and third tests, the counselor informed McCullough that you [Williams] would only use the first test in determining his sanction."

When McCullough asked to speak to Williams during his hearing, he said, "[The urine] was tested three times. I passed that, okay? I can't explain to you why. All I know is what I've done and what I haven't done, your honor.

"Williams: Well, you know, I don't believe you.

"McCullough: I'm not going to go 22 months with clean time and then three months from my graduation [from drug court] to use."

"Williams: Well, people have done it.

"Consequently, you sentenced McCullough to 17 days in the county jail. Court records show that the 17 days is comprised of two sanctions: 3 days for having a positive drug test and 14 days for 'disputing the initial screen.'"

The JQC also accuses Williams of making snap rulings without consulting opposing counsel, including granting an order allowing a defendant appearing before her in a child support case to consolidate an active criminal drug court charge with the child support case.

When opposing counsel, attorney J. Robert Morgan, learned of the order, he requested a meeting with Williams and the public defender.

"At this meeting, Attorney Morgan objected to your [Williams'] consolidation of the criminal and civil cases. In response, you told Attorney Morgan, 'I do not give a shit' who hears these cases," the complaint states.

"In response, Attorney Morgan presented you two 'Orders for Voluntary Recusal.' You refused to sign the orders and began yelling and cursing at Attorney Morgan.

"You initially refused to recuse yourself, but then improperly reassigned the cases to another judge you selected."

The JQC also accused Williams of nepotism by, inter alia, appointing her daughter as a guardian ad litem.

"You violated Canon 2B of the Code of Judicial Conduct when you showed favoritism in your order requiring payment to your daughter, under penalty of contempt, and in doing so allowed your family relationships to influence your judicial conduct," the complaint states.

"d. You violated Canon 2A ('judges shall respect and comply with the law') and Canon 3 ('judges shall disqualify in any proceeding in which their impartiality might reasonably be questioned') of the Code of Judicial Conduct when you failed to recuse yourself in a matter where a member of your family appeared before you as guardian ad litem.

"e. You violated Canon 3 ('judges shall disqualify in any proceeding in which their impartiality might reasonably be questioned') of the Code of Judicial Conduct when you failed to recuse yourself in cases where you had a conflict because your children and your husband appeared before you in the capacity as the lawyer in the proceeding.

"f. You violated Canon 3E of the Code of Judicial Conduct when you presided over a case in which you were disqualified and which you had previously reassigned to another judge.

"g. You violated Canon 3E of the Code of Judicial Conduct when you, having been disqualified, heard matters on an alleged 'emergency basis' under the 'rule of necessity' when no such emergency existed."

These accusations - Count Four - are more particularly described, as follows.

In the case of Walden v. Walden v. Gamer (as intervenor), a divorce action involving the custody of two minor children, on or about August 6, 2009, you heard a matter involving temporary custody. The litigant parents both appeared pro se. Garner, the great-grandmother, as intervenor, was represented by counsel.

"Also present in the courtroom was your daughter, Attorney Frances Williams Dyal. You asked your daughter, 'Frances, come forward. Go talk to these people [about the children].' Attorney Dyal, the father and Garner left the courtroom to discuss the matter. Garner's counsel remained in the courtroom and the mother was instructed to wait in the outer hallway.

"After a short period, Attorney Dyal, the father, and Garner returned to the courtroom and, along with Garner's counsel, approached the bench. Attorney Dyal, acting as the appointed guardian ad litem, recommended to you that temporary custody be given to Garner. You accepted your daughter's recommendation and instructed Garner's counsel to prepare an order.

"The mother had no opportunity to be heard on, challenge, participate in, or cross-examine Attorney Dyal's findings. You failed to allow all parties to be heard prior to accepting your daughter's recommendation.

"Attorney Dyal was operating under no written appointment as a guardian ad

litem. There was no disclosure on the record, or otherwise, to any party regarding

your familial relationship with Attorney Dyal." (Parentheses and brackets in complaint.)

The JQC says defendants were at the mercy of Williams' whims - and that she ordered one man "summarily jailed" for using slang, which was not obscene.

"A drug court defendant appeared before you to request to be excused from a Saturday class for a family function," the complaint states. "Because of your disdain for the young man's use of the term 'baby momma,' you ordered that the defendant be summarily jailed.

"You have often appeared frustrated with drug court defendants who wished to address the court, gesturing with your hand and saying 'don't talk to me.' Any further attempt by the defendant to speak would often result in you directing the bailiff to take them into custody. When the bailiff inquired about the duration of detention, you often replied that you did not know and/or to make it for an indefinite period of time."

Count 11 states, in its entirety: "The conduct in Counts One through Nine violates Canon 2 of the Code of Judicial Conduct, and O.C.G.A. §45-11-4, which prohibits you from 'using tyrannical partiality in the administration or under the color of [your] office.'" (Brackets in complaint.)

County 12 accuses Williams of making false statements during the JQC's investigation.

Williams has 30 days to respond to the complaint or to resign.

If she does not resign, the JQC, a seven-member panel of two judges, three attorneys and two private citizens, will hear the trial.

If the ethics violations are proven, the commission will issue a recommendation on disciplinary action. It's up to the Georgia Supreme Court to issue a final ruling.

Ethics Complaint Against Mayor and Entire City Council

Ethics complaint against Chief Hatch, Mayor Deloughy, and the entire City Council

Chief Hatch has lied about several things in my case. Many of you have seen the evidence I have provided.

First, Chief Hatch lied about an internal investigation I requested after my arrest. Chief Hatch said no such investigation took place, but I received a bill for my open records request for that document. Also in the email in response to my request, Chief Hatch stated it was not done yet, and he would send the final copy and the amount for the cost to the City Clerk for me to pay before I picked up the paperwork. Please find the enclosed documentation.

Second, I requested a second internal investigation one year later, claiming Joshua Hamlett falsified the police report in my case. Upon completion of this request, I got a copy and found it very disturbing. First the investigator didn’t do a complete investigation. He took the accused (Hamlett) word for it. If they would have done a complete investigation the 911 tapes would have been listened to and the investigator would have heard the Sheriff as the second caller, yet the investigator listed as an unknown caller. The sheriff says as 911 answers “This is the Sheriff”. They did not pull the CAD report from the 911 center that proves Hamlett couldn’t have done all that he said he did, as the CAD report lists him as being at the doctors office for only 20 minutes.

Third, when I started sending all this information to Chief Hatch, He took it as a threat and told me not to email him again. Since when is sending information about a case a threat? Maybe when that person knows he is caught in a huge lie.

Fourth, your city manager in defense of Chief Hatch sends me a threatening email and copied the city attorney on it stating that I need to remove an image that I use on Topix. This image is of Chief Hatch, and it was taken off a public domain website. Later after I returned Mr. Crowell email and stated that no laws were broken by my use of this image, Crowell admitted that is was not illegal, so why did he email me was it INTIMADATION?

And last but not least, The Mayor and entire city council has ignored every bit of this. They have ignored several complaints against Chief Hatch even after I predicted that Officer Hamlett would quit after I filed the second internal investigation. Oh by the way, he did quit 2 days later. All other officers in this case, also quit.

FBI may investigate 2010 police shooting that killed Brunswick woman

The fatal shooting of a Brunswick woman by two veteran Glynn County police officers last year has attracted the attention of federal law enforcement authorities.

Sgt. Corey Sasser and Officer Todd Simpson fired eight .45-caliber bullets at Caroline McGehee Small as she tried to maneuver her boxed-in car, its four tires shredded down to the rims, following an erratic low-speed pursuit on June 18, 2010.

Two bullets struck Small, who had cocaine in her system, in the face. Small, 35, died without regaining consciousness one week later at a Savannah hospital. A mother of two young daughters, Small had a history of drug abuse and running from the police.

“It has come to our interest. …The shooting has been brought to our attention,” Lawrence J. Greene, the FBI’s supervisory senior resident agent in Savannah told the Times-Union.

Citing FBI policy, Greene would not confirm nor deny whether it has officially opened an investigation into the shooting. Greene declined comment about when or how the FBI was alerted to the case.

Officials with the U.S. Attorney’s Office for the Southern District of Georgia also declined comment. Georgia Bureau of Investigation officials would not comment either.

After the shooting, Sasser and Simpson talked about their marksmanship instead of checking to see if she was alive, according to recordings made by police dashboard video cameras.

Sasser, who had fired six shots, said he’d hit Small “right in the bridge of the nose.”

A witness said Simpson, who fired twice, told him that Small was dead because he had shot her in the head and “her head exploded.”

Those details are among the evidence contained in a 540-page case file the GBI recently released to the Times-Union in response to an open records request.

A Glynn County grand jury, in a 12-6 decision, cleared Sasser and Simpson of any criminal wrongdoing.

Both officers also were cleared by a police internal investigation. They remain with the Glynn police department.

St. Marys Police Chief Tim Hatch Sends Threatening Email

In light of the recent emails and phone calls that I have received from you, and the abusive, harassing and threatening nature of your communications, I am using this email to notify you that I will no longer accept your calls or your emails. Any contact that occurs between us will require your attorney to contact the City’s attorney in order for me to consider responding. Issues relating to your pending court case need to be presented to the judge on your court date. Future Open Records Requests need to be directed to Mrs. Darlene Roellig, City Clerk. Lastly, I want to caution you that the harassing and threatening nature of your communications, if they do not cease, may result in my seeking legal remedy through my personal attorney.

Sheriff's attorney questions quality of letters to the editor

Dear Editor,

I have no desire to engage in a letter-writing campaign concerning my client, Sheriff Bill Smith. I am writing in response to Robert Southwell's recent letter to the editor ("Sheriff's ethics, competence called to question," Jan. 12) only because I am mentioned, not only by name, but also in a way that could subject Mr. Southwell (and also your newspaper) to a valid claim for defamation.The recent controversy in which I represented Sheriff Smith before the State Ethics Commission was minor at best. The only thing Sheriff Smith did wrong was to inadvertently fail to mention two or three low value pieces of property he had inherited from his parents in a 2002 financial disclosure statement. The theory behind the original complaint, filed by a thoroughly-defeated political adversary, was that if the voters had known of the omission, it might have affected somebody's vote. Sheriff Smith got about 85 percent of the votes in that election, and, if everybody in Camden County had known of the minor omission, I don't think it would have changed a single vote.The only reason Sheriff Smith paid the $1,500 fine was because I advised him that the value of his service to Camden County for the entire day, when he would otherwise have been required to come to Atlanta to appear before the commission, was more than $1,500.Camden County is fortunate to have a sheriff with the competency and good character of Bill Smith. I am proud to consider him a long-time good friend, as well as a client.

By Sheriff Bill Smith admitting that he paid a fine to the State Ethics Commission confirms the fact that his ethics are the reason we question his competency as a sheriff of Camden County.

He has no problem answering to the State Ethics Commission through his attorney, Taylor W. Jones, who in my opinion sounds like a salesman with a mouth full of samples.

To the citizens of this county: If we don't vote him out in the next election, we will be subjected to this type of unjust justice for years to come. We need to stand up and elect an objective sheriff. I'm starting early on this campaign, and our next sheriff's last name should not be Proctor.

This is the report from my complaint stating that Josh Hamlett submitted a false incident report.

Of course these people police themselves so the great detective Johnny Guy said there was no wrong doing by Hamlett.

Well in reviewing the documents I noticed in point #1 that it stated that the St. Marys Police had no idea who the second 911 caller was.

Well folks this will tell you what kind of people we have working for you. These people carry guns and can get away with shooing you. Yet they can't even listen to a simple audio recording.

Information that all of us new was true and the St. Marys Police Department ignored it and hired Godley anyways. But now this blogger is coming after them and now they will check out this site daily!!!

As for my open records request, it has been nearly two weeks since a request a copy of the internal investigation of my arrest from over a year ago. This report has been finished and a cost for the report was sent to me over a year ago. But since that time I have requested another investigation into a false police report, and now they will not release the first report. Why? Are they changing things in the report?

The City of St. Marys appeals from an adverse verdict in consolidated section 1983 actions which were based upon allegations that the city knowingly approved a pattern of improper police conduct consisting of acts of violence, intimidation, and humiliation.1 Appellant maintains that the evidence was insufficient to prove a policy or custom establishing the city's fault regarding the constitutional deprivation of plaintiffs' rights. In addition, appellant maintains that plaintiffs were not denied due process because adequate state remedies exist.2 Because we find that the evidence supports the verdict, and that the existence of a state remedy does not bar a section 1983 action of this type, we affirm.

* There was sufficient evidence before the jury from which the following facts could be inferred. On July 22, 1983, plaintiffs, Fowler and Depew, began repairing a customer's jeep at Fowler's garage. After completing the repairs at 1:30 a.m. the next day, plaintiffs took the jeep for a test drive. Fowler noticed a problem with the steering, so he allowed the jeep to veer to the right on two occasions and was subsequently stopped by Officer Kusek.

Fowler explained what he was doing, but was told he had to submit to a sobriety test although none of the officers detected any alcohol odor on his breath. Fowler readily agreed to take the test. Later, a lab report showed negative alcohol content.

While Kusek went to his car, apparently to obtain the test equipment, Fowler sat down in the jeep. When Kusek returned to the jeep, he grabbed Fowler around the neck and tried to drag him from the jeep. Fowler clung to the steering wheel, because he was surprised and frightened. When Kusek was unable to drag Fowler from the jeep, he demanded Depew's assistance. Depew, however, refused to interfere in any manner.

After a short while, several other officers arrived at the scene. One officer held Depew at gunpoint while he was handcuffed. Other officers helped Kusek drag Fowler from the vehicle. Then, Fowler was thrown to the ground and beaten by the officers before he was handcuffed. Depew was taken directly to jail, while Fowler was taken to a hospital for blood tests.

Plaintiffs subsequently filed these actions against the city and other parties. Plaintiffs alleged that their civil rights were violated due to the use of excessive or unreasonable force by the city's police officers. Liability was asserted against the city based on allegations that the mayor and city council had knowingly established a policy or custom of police misconduct. During trial, the evidence revealed several prior incidents of police misconduct. The evidence also indicated that the city failed to train, supervise, and discipline its police officers as required.

Ms. Donini testified that she had been harassed and forcibly placed in a police car by the city's officers during their apprehension of a suspect on her property in 1981. When she complained of a violation of her rights, she was informed that she had no rights. Moreover, her complaints were largely ignored by the mayor and council members. In fact, the city commended the officers for their actions.

Ms. Crumbley, a council member since 1979, testified that the council was aware of the Donini incident and another incident involving Michael Dixon. Mr. Dixon had also initiated a lawsuit alleging police brutality. Crumbley denied that the officers acted improperly, and maintained that these cases were settled merely to preserve peace in the community.

Mr. Dyals, a council member since 1980 and former chairman of the police subcommittee, stated that he was unaware of any investigation or disciplinary measures regarding the Donini or Dixon matters. Similarly, when questioned about another incident involving David Chaney, he could not remember any investigation regarding the matter.3

Councilman Saunders initially testified that no action had been taken by the council in the Donini and Dixon matters; however, he later testified that the Donini matter had been investigated. He stated that the council concluded that the officers had acted correctly. He also admitted that no action had been taken to alter police policy.

Additional evidence indicated that other complaints of police misconduct existed. Officer Ring remembered a complaint involving Officer Murray, but could not recall the details. Similarly, Officer Wiggins, a former training officer, was disciplined when he struck a handcuffed prisoner for no apparent reason.

The evidence relating to the lack of proper training, supervision, and discipline consisted of various personnel evaluation reports, employee warning reports, directives promulgated by Chief Keele, and the testimony of various witnesses. For example, Officer Ring was never disciplined other than by verbal reprimand although he had been cited for poor and improper work on many occasions. Similarly, while Officers Halley and Kaser were known to be hot tempered, both officers remained on patrol duty.

Chief Keele admitted that he had disciplinary problems with his officers. Nevertheless, he did little to rectify the problem. In fact, he stated, "At six bucks an hour, you take what you can get."

While the parties presented conflicting evidence, testimony indicated that the officers received inadequate training concerning the use of force in any given situation and when the use of deadly force was proper. Officer Sanders testified that no instructions on this subject were issued by the department. Moreover, Sanders candidly stated that excessive force was used against Fowler, but that it was nothing that he had not seen before.

The evidence also demonstrated that officers had little incentive to learn the policy and directives of the police department. If an officer failed an examination on the department's policy and directives, he remained in the same position, with the same duties, and he received the same wages. His sole penalty was that he was not promoted to a higher rank.

The mayor and council showed no inclination to change police policy. In fact, while the mayor and council members were aware of prior complaints of excessive force, they continued to assert that the department's supervision was satisfactory and that the officers were doing a good job.

At the conclusion of plaintiff's case, defendants moved for a directed verdict. The motion was denied. After the jury returned a verdict against the city, defendants moved for judgment notwithstanding the verdict. Finding the evidence sufficient to support plaintiffs' claims, the district judge denied this motion as well.II

The City of St. Marys contends that the evidence was insufficient to support the jury's verdict which was based on a finding of custom or policy on the part of the city resulting in plaintiffs' injuries. When considering the sufficiency of the evidence, this court must consider the evidence in a light most favorable to the plaintiffs and give them the benefit of all inferences which the evidence supports. This court must affirm unless it is convinced that there is a complete absence of probative evidence supporting the verdict or that the evidence so overwhelmingly supports the city that reasonable men in the exercise of impartial judgment could not render a verdict against it.

Section 1983 generally makes every person liable for conduct which deprives any citizen of the United States of any right, privilege or immunity secured by the Constitution. 42 U.S.C. Sec. 1983 (1982). For purposes of this statute, municipalities are persons. Monell v. Department of Social Services, 436 U.S. 658, 98 S.Ct. 2018, 56 L.Ed.2d 611 (1978). Section 1983 provides a fault-based analysis for imposing municipal liability; therefore, plaintiffs must establish that the city was the person who caused them to be subjected to their deprivation. To establish a policy or custom, it is generally necessary to show a persistent and wide-spread practice. Moreover, actual or constructive knowledge of such customs must be attributed to the governing body of the municipality. Normally random acts or isolated incidents are insufficient to establish a custom or policy. Bennett v. City of Slidell, 728 F.2d 762, on rehearing, 735 F.2d 861 (5th Cir.1984) (en banc). However, the custom need not receive formal approval. Monell, 436 U.S. at 691, 98 S.Ct. at 2036.

In this case, while the city provided rules and regulations for the operation of its police department, these rules were violated on numerous occasions. The city, however, failed to rectify the situation. The evidence revealed several incidents involving the use of unreasonable and excessive force by police officers. Therefore, the city had knowledge of improper police conduct, but failed to take proper remedial action. The continued failure of the city to prevent known constitutional violations by its police force is precisely the type of informal policy or custom that is actionable under section 1983. See Herrera v. Valentine, 653 F.2d 1220, 1224 (8th Cir.1981); See also Turpin v. Mailet, 619 F.2d 196 (2d Cir.), cert. denied, 449 U.S. 1016, 101 S.Ct. 577, 66 L.Ed.2d 475 (1980).

Appellant maintains that plaintiffs failed to state a claim under section 1983, because they had an adequate remedy under state law and were not denied due process. Plaintiffs can pursue claims for false imprisonment, false arrest, and assault and battery in state court. Since state law provides plaintiffs with these post-deprivation remedies, appellant asserts that plaintiffs have received all the process which they are due under the Fourteenth Amendment.

Parratt v. Taylor, 451 U.S. 527, 101 S.Ct. 1908, 68 L.Ed.2d 420 (1981) is the starting point for discussion. Parratt involved a section 1983 suit for damages of $23.50 brought by an inmate for the negligent deprivation of property without due process of law. The court concluded that the due process clause was not violated because plaintiff had an adequate state remedy. A pre-deprivation hearing was not practical and a post-deprivation hearing was available. Id. at 543, 101 S.Ct. at 1916. The court emphasized the need for this result. Otherwise, every injury caused by a state official under color of law would constitute a due process violation and would be actionable under section 1983. Id. at 544, 101 S.Ct. at 1917. Justices Stewart and Powell concurred, because they did not believe the claim rose to the level of a deprivation of property under the Constitution. Id. 544, 546, 101 S.Ct. 1917, 1918. Justices White and Blackmun emphasized that the opinion was limited to deprivations of property and did not encompass deprivations of life or liberty. Id. at 545, 101 S.Ct. at (White and Blackmun concurring).

In Hudson v. Palmer, 468 U.S. 517, 104 S.Ct. 3194, 82 L.Ed.2d 393 (1984), the court dealt with an intentional deprivation of property through an unauthorized act by a state employee. The court extended the holding in Parratt to include intentional deprivations of property where it was impractical to hold a pre-deprivation hearing and where an adequate state remedy existed. The court's holding, however, was based on the fact that the action was unauthorized.

We reasoned that where a loss of property is occasioned by a random, unauthorized act by a state employee, rather than by an established state procedure, the state cannot predict when the loss will occur.

Id. 104 S.Ct. at 3203. The Court reasoned that while the action was under color of law, the unauthorized acts were beyond the control of the state. The Court then discussed Logan v. Zimmerman Brush Co., 455 U.S. 422, 102 S.Ct. 1148, 71 L.Ed.2d 265 (1982). In Logan, the court reaffirmed Parratt but distinguished it.

We specifically distinguished the case from Parratt by noting that "Parratt ... was dealing with a ... 'random and unauthorized act by a state employee ... [and was] not a result of some established state procedure.' " Parratt, we said, "was not designed to reach ... a situation" where the deprivation is the result of an established state procedure.

Gilmere v. City of Atlanta, 737 F.2d 894 (11th Cir.1984), rev'd, 774 F.2d 1495 (11th Cir.1985) (en banc) is the critical Eleventh Circuit decision regarding this issue. In Gilmere, plaintiff's decedent was killed by police officers during arrest. The court ruled that the state survivor tort remedy was all the process that was due because the conduct was random and unauthorized, and a pre-deprivation hearing was impractical. The court then extended the holdings of Parratt and Hudson to include negligent and intentional deprivations of liberty. The court avoided ruling on whether the same result would have been proper for a violation of substantive due process. In fact, the court specifically stated:

Thus our holding today is in line with Duncan v. Poythress, 657 F.2d 691, 704 (5th Cir.1981) where the plaintiff's claim was held to be not barred by Parratt because it was based on the substantive due process right to vote. Additionally, the acts of the police here, although most unfortunate, did not "offend those canons of decency and fairness which express the notions of English-speaking peoples even toward those charged with the most heinous offense" or "shock the conscience," so as to violate the substantive due process guarantees "implicit in the concept of ordered liberty."

Id. at 910 (citations omitted).

Upon rehearing, the court stated:

We accepted this case for en banc consideration primarily to determine whether Parratt v. Taylor precludes a claim by his administratrix under 42 U.S.C. Sec. 1983 because state tort law provides a comparable remedy.

Gilmere, at 1496 (citations omitted). The court concluded that plaintiff's action was not barred.

Having thus found that the scope of Parratt is necessarily limited by both the legislative history of section 1983 and the Supreme Court's own pronouncements, we perceive at least two alternative constitutional theories ... on which this plaintiff may predicate her section 1983 claim for relief against the police officers.

Id. at 1499.

In Gilmere, the court articulated two theories which allow injured parties to bring actions pursuant to section 1983 regardless of whether an adequate state remedy was available. First, an individual can maintain a section 1983 action whenever the government's conduct violates substantive due process. Id. at 1501. Similarly, an individual can bring a section 1983 action based upon Fourth Amendment violations. Id. at 1502.

Here, the jury determined that the City of St. Marys had implicitly ratified a custom or policy permitting the police to use excessive force against its citizens. The use of "excessive" force in making an arrest constitutes an unreasonable seizure. Therefore, the plaintiffs are entitled to maintain a section 1983 action in spite of the existence of any state remedies.4

The evidence was far from overwhelming, but it was sufficient to support the jury's verdict. The jury was entitled to draw all reasonable inferences from the evidence and evaluate the credibility of the witnesses. The evidence revealed sufficient prior incidents where the police had used excessive force to put the city on notice. Yet, the city failed to take proper remedial action. This evidence was sufficient to support a finding that the city's officials implicitly ratified a custom which resulted in plaintiffs' injuries. Based on this evidence, the plaintiffs are entitled to maintain a section 1983 action in federal court regardless of the existence of any state remedy. Thus, we AFFIRM.

First, I was accused of hacking the blog 4 the badge. You all remember that blog don’t you? That was a pro-Smith blog that like to trash both Jay and myself.

Second, I was accused of hacking former Camden County native Trip Casey’s blog about Gregory being a one term Sheriff. Even though it is plain as day they he (Trip) had taken the blog down, as his website displays the same message mine did for months.

Third, I stole government documents pertaining to Bob’s looking at porn on government computers. That’s right folks, now I have hacked into the Navy’s computers.

And I also stole his P.O.S.T. file as well.

Then, when I requested a lie detector test, Godley and friends said that I would be able to fake the test, thus causing a different result than not telling the truth!

Me, me of all people able to fake a lie detector test!!!!

Last week I emailed the St. Marys City Council, The Chief Of Police, and The Mayor. I informed them of the fact that Bob Godley had some interesting friends on his face book page.

Well low and behold just a day later Bob hides his friends from public view. Amazing isn't it.

FLASHBACK:

While I was in jail Bob started a thread on Topix remember about me and my wife going to jail, remember?

Once I was bailed out, I immediately insisted on an internal investigation into the St. Marys PD on my arrest and Bob's involvement. As soon as I pointed out Bob's post to the SMPD all Bob's posts were removed.

At this time no Conciliation Agreements have been reached between the EEOC, the Charging Party (RG) and the Respondent (CCSO).
The County Attorney has advised, in the event a settlement agreement is reached with the EEOC, you must understand that these are confidential agreements per Federal Statute and are not subject to disclosure, as a stipulation of the settlement agreement between all parties.

No, any settlement agreements would be between the Camden County Sheriff's Office and the EEOC representing Robert Godley.

No, the Board of County Commissioners is not a party to this EEOC Complaint. The Insurance Company is providing a defense for the Camden County Sheriff's Office under the Law Enforcement Insurance Liability Policy.

In other words the commissioners will not work out the agreement with Godley, only the Sheriff and the EEOC. Correct?

Negotiations are through the Insurance Defense Firm and the EEOC, an organization, representing Robert Godley. Any settlement offers from the EEOC would be directed to the Camden County Sheriff's Office and the Board of County Commissioners would not be required to approve.

However, in the event that the insurance company wants to settle a claim or suit it will consult with the Sheriff of their intentions. If the Sheriff refuses to consent to any settlement offer the insurance company wishes to settle, the County coffers (TAXPAYER DOLLARS) would assume liability costs above the amount as of the date of such refusal.

Is The St. Marys PD Is Investigating This Site Or Are They Sending Out Threatening Posts?

The following is of course from my sitemeter account. This tells me who has been on my site. Now I have told you people time and time again, if you work for the government and you post from a government computer, it will show up just like this!!!!

Now I know most of you cops are really good people, but you do have a few dumbasses. When you post to my blog, it sends me an email that contains everything in that post. Now they may have made these posts in front of their "so called friends", thinking they werealmighty and powerful cops, then later they would delete them as the author of any post may delete their comments. But that email does not change so I have the original post. HAHA.

Well I submitted and open records act request to Chief Hatch who of course responded with:

A record does exist; any good IT person can pull it up in minutes. Bill Smith tried to say the same exact thing when Charlene Sears posted my background on my blog; I proved him wrong and got her name.

Now would you like me to do the same here? All I am asking is for is the name of the person using that computer with that IP Address at 2:30 AM Friday February 11.

Now if silly little games are what you want to play, we can!! I rather just get the name and move on. I do believe the City of St. Marys has enough problems with out another cover up at the police station. If your IT can't figure it out, call Kingsland they can track peoples IP Address straight to their home, I am sure they would be able to help YOUR INCOMPETENT IT PERSON.

The City of St Marys is in receipt of your Open Records Request stamp dated February 25, 2011 at 1:10 p.m. In answer to your request, the operator of the device at IP address 216.170.177.35 is the IT Network Administrator of the City of St. Marys, and he was not logged into the device at 2:30 a.m. As this is a firewall device, it has Network Address Translation protocol enabled. However, log files are purged every 12 hours, to conserve storage space on the firewall device.

To fulfill the request, it would require approximately 6-8 hours reviewing the individual log files for all operators on all systems, as the City does not have a Web Content Filtering System. Since this request exceeds the technical level of the Systems Analyst (lowest paid full-time employee), the Network Administrator would perform the search, retrieval, or other direct administration required. This action is estimated at a cost of $31.55 per hour (6-8 hrs.), provided; however, that no charge shall be made for the first quarter hour as per the Georgia Open Records Act. The costs associated with the request will not exceed $220.82.

In order to move forward, please sign the attached form and return it to the City Clerk’s office at the address below, as your agreement to pay the costs related to the request. If the executed form is not received, the IT Department will not be authorized to proceed. Once the request is completed you will be contacted with the final cost so payment could be made to the City for the information to be released.

Here's the good news: the pathetic and administratively corrupt reign of Roswell's embattled Police Chief Ed Williams is finally about to come to a close.

Here's the good news: the pathetic and administratively corrupt reign of Roswell's embattled Police Chief Ed Williams [pictured left] is finally about to come to a close. Williams, who resigned last fall, should be out by February 1.

Williams Napoleonic-like dynasty of Roswell's cops has been marred with charges of blatant nepotism, unseemly political pay-backs, nefarious DUI quotas, overt crony favoritism, shifty organizational charts, lost files, disappearing evidence, missing money, flash bang lawsuits, wrongful demotion charges, stonewalling of open records requests from the press and downright police harassment of innocent citizens (re: Andrew Wordes).
All the while Roswell City Administrator Kay Love sat back and did nothing to stop Williams's ongoing empire of perverted narcissism.
So good cops quit. Others checked out. Police morale among RPD's rank and file hovers at an all time low.
That's William's Roswell legacy.
Good riddance, Ed.
And by the way, don't let the door smack you in the keister on the way out.

LOVE SHACKELS

City officials announced they have narrowed their search for a new police chief to three candidates. Two of the three finalists are chiefs and one is a public safety director. All serve in southern Georgia. The three finalists are: Chief Woodrow Blue, Milledgeville, Chief Tim Hatch, St. Mary's and Public Safety Director Dwayne Orrick, Cordele.

Now the bad news: Love, who has been intimidated by Williams during her entire$200,000 salary "Peter Principal-esque" rule in Roswell, has refused to release details about her selection process -- or facts on her choices -- to the press or the public. This is par for the Love course: the Roswell taxpayer: be damned.

Both Love [pictured right] and Williams rejected interviews and declined to answer questions from Beacon beat reporters Maggie West and Jeff Bean. No surprise there.

Most likely they'll wait to talk to their "shopper" lackeys who are on their legal advertisement public taxpayer funded payroll.

So what's going to be different, now that Williams is out? That depends on his replacement. That's why Love won't let the public know anything about her choice or how she'll make the decision. Or about what is really going on in the city's public safety division. For example, under pressure from the press (The Beacon), Williams finally released the RPD crime analysis report for the FY year ended June 30, 2010. It took nearly three years to get the last one updated from FY 2008, and FY 2009 is still nowhere to be found. Is this going to be the norm?

These questions linger: Why is Love reluctant to publicize her candidates' qualifications, like for example, their resume, including education and size of the force they currently supervise? Is there something to hide? Is the fifth largest city in the state of Georgia embarrassed by the caliber of their final candidates? Where is the transparency? The public and press can only conjecture.

But sources inside RPD, familiar with the candidates -- who are not authorized to speak to the press -- told The Beacon that Love's handpicked top cop is Orrick. They say the other applicants are mere smokescreens. "Orick is from Cordele, the same area as Williams and Love," one senior officer said. Another high ranking RPD lawman says Love and Williams want their own man -- someone they can control -- who won't be digging into files, cooperating with the press and embarrassing them further. "It'll be business as usual with a different name plate on the Chief's desk," one source sighed.

ONE TRICK PONIES

Records show that Love got applications from some heavy hitters with big city experience -- as well some Feds. But Love apparently is committed to going the po'-dunk route. Cordele? St. Mary's? Milledgeville? These are all backwoods South Georgia one-horse towns with less than 20,000 people. Does St. Mary's even have a traffic light?

Roswell has nearly 100,000 residents and is plagued with illegal immigrants running amuck, multiple gang activity, murders, armed robberies, rapes, break ins, etc.

So why not get a police chief from Philadelphia? Or even Marietta, or maybe Norcross?

Nope, Love wants another country bumpkin, just like Williams, who is from Americus. Misery, perhaps, loves company.

Sources with ties to the Fulton County Sheriff's Department told us point blank that one veteran Deputy applicant, who had FBI training, was told, when attempting to apply for the job through the Georgia Police Chief's organization, not to bother and waste his time. "We were informed [Roswell] was looking for applicant's with less experience," the source said.

When Alpharetta, a city half the size of Roswell, needed a senior lawman with some juice, do you know where their city administrator, Bob Regus went? Try Kansas City. That's where he got Gary George, their big dog. Where does Roswell go for theirs? Why that booming metropolis of Cordele, of course.

By the way, where is Roswell Councilwoman Nancy Diamond [pictured left], the citizens' liaison to public safety on this? We've not heard a peep out of her, either.

Shanahan Never worked "outside the box" For The City Of St. Marys

Shanahan, 53, was asked to describe a time when he worked "outside the box."

While he served in the U.S. Air Force, Shanahan responded, he was trying to bring various departments together to create a rapid-response force. But the people he was encouraging to work together didn't want to do so -- and they all outranked him.

So, he called a meeting before "happy hour" at the non-commissioned officers' club, and everyone showed up, getting the process started, Shanahan said. The audience chuckled.

Shanahan has been city manager in St. Marys, a town of about 21,000 people, for roughly six years. He was previously the county manager in Habersham County, Ga.

Shanahan said he practices "management by walking" -- essentially getting out and talking to people.

Shanahan, Douglas E. Smith, assistant city manager of Delray Beach, Fla., and Jefferson, Ga., City Manager John A. Ward III were named finalists today.

They were chosen from some 155 applications received by Augusta Human Resources.

All three hold master's degrees in public administration and have experience working in Georgia local governments, according to their resumes.

The deputy administrator position is designated as "chief operations officer" on a proposed restructuring chart put together by a team of city department heads and Administrator Fred Russell.

The COO oversees departments called environmental services; recreation, parks and facilities; utilities; engineering and emergency services, which include fire, 911, animal services, the inmate work camp and emergency management, according to the draft chart.

Mr. Mayor, when the letter said that the radio station had three days to respond, what would you have done if they didn't respond, as you had no legal actions you could take. Answer, Most likely they would have called in the corrupt St. Marys PD and have them arrest everyone at the radio station. After all, Rich

Recently on a similar website with a similar name there were accusations made that the City Manager and Mayor are in some type of panic mode. There are claims the City Manager Bill Shanahan was direct by Mayor Deloughy to seek out and find the signed petition that went to the Grand Jury. Keep in mind that this is only a rumor and there is no facts behind it at all. In fact it is just another untrue rumor by the Nutty Group and Alex Kearns to disrupt the Grand Jury process. The fact is there is not such directive to Shanahan by the Mayor to do any such thing.

There is also unfounded rumors that Bill Shanahan sent out FOIR’s to media outlets and others requesting copies or the signed Grand Jury petition. It was also lied about that he is so stupid that he does not know that the FOIR’s are only for government entities. No one is stupid enough to believe that a City Manager does not understand the process of a FOIR and who they can submit it to. Again it is another lame attempt by the Nutty Group and Alex Kearns to try to frame this debate. This site and others have gone along way in debunking these liars.

Roswell narrows search for new police chief to three candidates

After taking early retirement, Roswell Police Chief Ed Williams’ last day on the job will be Feb. 1.

And whether it’s due to factors like a bad economy or Roswell’s reputation, the city has seen no lack of hopeful candidates for Williams’ job.

“We received 67 applications for the police chief position,” said City Administrator Kay Love. “We used the Georgia Association of Chiefs of Police to conduct an assessment center as part of the process.”

Seven semi-finalists participated in the assessment center. From that process, the field has been narrowed to three, all from Georgia.

Woodrow W. Blue, Jr. has been chief of police in Milledgeville since 2002. The most current population figure of the city is 21,008 and the department has 65 employees, although it is unclear how many of them are uniformed personnel.

Blue came to Milledgeville as deputy chief in 2000 from Hahira, Ga., where he was the chief. The city in Lowndes County has 2,328 residents.

Blue has a bachelor of science in criminal justice from Valdosta State University and a masters of public administration from Columbus State University. He has been a police officer since 1980.

He was appointed by Gov. Sonny Perdue to the Private Detective and Security Board in 2003 and was reappointed in 2009 to a four-year-term.

Timothy “Tim” Hatch is currently police chief in St. Mary’s, a city that in 2009 had 16,778 residents and a 37-officer police department.

Prior to St. Mary’s, Hatch was a captain in the Henry County Police, an agency serving a population of 191,502 as of 2008.

His criminal justice bachelor’s degree came from Mercer University and he holds a certificate of local government management from University of Georgia.

Hatch is a graduate of the FBI National Academy in Quantico, Va. He has experience as a criminal investigator and has been a member and commander of a Special Weapons and Tactics, or SWAT, team in Henry County.

William D. Orrick is the Director of Public Safety in Cordele, where he was police chief from 1990 to 2006. As of 2009, Cordele’s population was 11,498. It has 65 full time and seven part-time employees, 40 of whom are police officers.

From 1986 to 1990, Orrick was a criminal justice management consultant for Georgia Department of Community Affairs. He was with the University of Georgia police department for three years, and holds a bachelor’s in criminal justice and masters degree in public administration from that school.

Orrick also is a graduate of the FBI National Academy and is a National Institute of Ethics Instructor.

Love will recommend one of the three to elected officials.

“The mayor and council will review and discuss my recommendation for police chief in closure at one or both of the January council meetings and a chief will be named by the time Chief Williams retires,” she said.

No Hatch did not get the job, maybe the Roswell City Council did a google search and found out what Hatch is really about. Why would they want to replace a police chief that was accused of cover ups with another one that is accused of cover ups?

Why would Hatch run from his problems here? Because he knows when the truth comes out (in court), his department will be so embarrassed that most if not all the cops will resign. Most likely because the City won't be able to pay them because of the major lawsuit they will have.

I was told that Godley posted on this site and attributed his dismissal from NSB Security and subsequent TSA to my (Rich Gamble) being disgruntled over the election results.

This matter was long investigated and adminstrated before I retired and ran for sheriff. Godley should thank me for being fair and weighing the merits of each case. That prevented him from being indicted and only having to withstand adminstrative actions.

I was not the investigating agent, but rather the supervising agent that made that call. In our (NCIS) case Godley was charged with viewing child pornography on his work computer while he was the LT supervisor. Using his swipe card that granted him access into the space, it was easy to gather evidence and show it was Godley who had visited the sites on that occasion and a few others. However, his short duration on the child sites questioned his specific intent and I elected not to present it to the US Attorney. I told Godley this but I added we would seek job termnination and a copy of our report would be forwarded to POST, as appropriate. Godley was also required to report the matter to POST.

When Godley was being considered for the job at Security, I spoke highly about him and kept him in high esteem. The pornography incident tarnished that somewhat, but I attributed it to bad judgement, boredom, etc. It was what our investigation uncovered when I felt our profession would be better served without persons void of core values like that consistently displayed by Godley. Godley resigned after being investigated for stalking in Arizona. They provided the resignation, he provided the stalking during interview. Godley then became involved in another sexual matter at one of the depts north of Glynn. He reportedly "made out" in the lobby of one of the hotels in the presence of guest while in uniform and used his official position to threaten a rival suitor. He resigned under pressure.

It was the pattern that prompted me to report the matter to POST. He was terminated because the NSB CO did not want to employ someone looking at pornography on their computer when they should be guarding the base. The CO also did not understand why we would not pursue the child porn through the US Attorney.

Our (NCIS) computer forsenic expert advised me that Godley's short duration on the child sites would be a defense even though intent is not a required element. He explained it such that we could lose the case. At that time, we had a lot of cases and since there was administrative remedies, I decided to forego the referral.

Yes, I ran for sheriff and yes I lost by a wide margin. But my credentials and character are still impeccable. Also, words I spoke 4 years ago are currently being heard throughout the county.

I am not disgruntled. While I lost the race for sheriff, who was the real loser?

The Racheyl Brinson Incident –

Accident or Murder?

Sunday, November 25, 2001 was to be the day that Racheyl Brinson would tell her estranged husband,
Steven, that she wanted a divorce. That same day Racheyl’s life came to a sudden and tragic end. Steven
was the last person to see her alive.

Racheyl was 32 years old and the mother of a two year old son, Cole. Cole’s father was Steven Brinson. Steven was several years older than Racheyl when she began dating him while she was still in high school in Kingsland, Georgia. Racheyl had been a good student and an excellent athlete possessing cat-like agility. She
was able to compete with the boys in softball, football, gymnastics and other sports. Her father died when she was just fourteen. She took over the outdoor maintenance chores at home, including operating machinery
and caring for her riding horse.

After high school Racheyl attended Florida Community College in Jacksonville for a year learning computer skills. She then returned to home and worked for ten years as an assistant manager at a local auto parts
store. Steven was employed as an electrician. They married in 1989 and built a new house. Although the
future held promise, alcohol use and abuse crept into their lives, followed by Stephen’s infidelity. When
Steven promised to stop his philandering and be a responsible husband, Racheyl became pregnant and
Cole was born in October 1999. Then she obtained a better paying job working at the US Navy’s Kingsbay
Submarine Base. Soon Steven went back to drinking and staying out late, even missing work. He was allegedly stopped several times for DUI. But, his uncle was the county sheriff and the “good ole boy” system protected himfrom arrest. Domestic disturbances were reported to the police. But, Steven would simply leave before the cops arrived and no police action would occur.

Steven rarely babys at and spent little time with Cole. Racheyl was doing all of the household chores and the
outdoor maintenance as well. Her income alone was sufficient to maintain the home. Steven was not
contributing to supporting the family. He had become a liability and a physical threat. During the last week of
Racheyl’s life Steven had not been residing at home. Instead, he was staying at their camp at the Mumford Island Hunting Club in nearby Woodbine. Three of Racheyl’s friends later told private investigators that
Racheyl intended to ask Steven for a divorce on the day she died. On that fateful Sunday morning Racheyl’s
mother, Pat Smith, had taken Cole to church. Racheyl was at home, and had made plans to meet a girlfriend at the hunting club that afternoon. They planned to hunt deer from their tree stands. But that friend had to work over and was unable to keep the hunting date.

Pat said Racheyl was sober when she last saw her at about 2:40 PM. About one-half hour later Racheyl and
Steven were observed by several other hunt club members as they were sighting in their rifles at the club’s
shooting range. These witnesses later said that Steven and Racheyl were both drinking a beer, but both
appeared to be sober when the parted company at 3:30PM. There would be just a couple of hours of daylight left for hunting. This was the last time that anyone other than Steven saw Racheyl alive.

According to Steven, he drove Racheyl several miles from the shooting range to the spot where they normally hunted. He claimed that Racheyl didn’t want to hunt from her usual tree stand and chose to use one that hadnot been used for years and had been decaying. Steven said he walked in an opposite direction to hunt from astand a few hundred yards away. The plan was to meet back at their truck at dark, he said.

When Racheyl didn’t show up, a little before 6:00 PM as planned, Steven said that he walked back to her
stand where he found her lying face down at the base of the tree. He said he checked for vital signs, then went back to his truck and used his CB radio to call for help. He also called 911 from his cell phone. Racheyl was deceased when rescuers arrived.

Camden County Sheriff’s deputies had responded to the call. Accepting Steven’s account at face value,
they notified the GBNR (Georgia Bureau of Natural Resources). Since this was considered to be a hunting
accident, that agency was designated to conduct the official investigation. By the time an agent arrived, the
incident scene had been abandoned. No physical evidence had been collected and no crime scene
preserved. No photographs had been taken to document the scene. No physical examination of Steven’s body was made to search for injuries or other evidence of a scuffle.

Two days later Doctor Lora Darrisaw, GBI (Georgia Bureau of Investigation), performed an autopsy. She
has since acknowledged that, had she been told about domestic violence, she would have been more vigilant
in her examination. She determined that the cause of death was “blunt force trauma of the head comprised of
a complete transverse basiiar skull fracture (middle cranial fossa)”. Other injuries noted included “blunt force injuries of chest”, “multiple right posterior rib fractures” and “fracture of the right clavicle”. Based upon the autopsy report and the statement provided by Steven Brinson, the coroner ruled the manner of death as “accidental” due to the victim falling from a tree stand.

Curiously, although the witnesses who saw Racheyl at 3:30 said that she appeared to be sober; and,
considering that she was supposed to have been hunting from a tree stand thereafter; her BAC was reported tobe .15 per cent, nearly double the legal limit for DUI.

This begs the question, “Was Racheyl actually hunting alone from a tree stand? Or, did she continue to drink
alcohol and not go hunting at all?” Questions arose about the competency of the GBNR to conduct a thorough death investigation, which should have occurred in this case. Did the relationship between Steven Brinson and the sheriff influence the efforts of the investigator(s)? Why was the scene not documented
by photography? Why was the medical examiner not told of domestic violence? Did Racheyl tell Steven she
wanted a divorce? If so, did Steven react violently and beat Racheyl? Is it likely that a person as agile as
Racheyl would have fallen from a tree stand?

These are some of the many unanswered questions that tormented Pat Smith. She could get no answers
from the authorities. She sought help from her local legislator, from the state’s attorney general and others,
but no one would agree to investigate further. So, in 2003, after hearing positive comments about fellow
Vidocq Society member Robert Ressler, Pat contacted him and asked him to help. Due to other commitments, Mr. Ressler referred the matter to Rich Graham and his partner, Betsy Ross, of RGI (Ross-Graham Investigations).

Reports of RGI’s findings have been provided to the GBI, the county coroner and others. Although much
credible evidence was developed that suggests this was a homicide, the coroner has refused to change his ruling as to the manner of death, which officially remains “accidental”. Even a finding of “equivocal”, if not
“homicide”, would probably suffice to prompt the local prosecutor and state authorities to reopen the case. But, the coroner remains steadfast with his ruling.

Racheyl’s family and friends, though discouraged, continue to hold out the hope that one day some
responsible person in authority will act responsibly and reopen the case.

Today a Camden County Sheriff’s Deputy was shot with a Canon by a motorist on I-95. Fortunately for the deputy there were no injuries due to this alleged assault. The Sheriff’s department was quick to respond and was immediately able to track down the culprits who did this dastardly deed.

Due to the fact that the officer was not injured in this incident, no arrest was made (which would be very unusual in Camden County Georgia). The Sheriffs Department in Camden County takes a very proactive stance to traffic enforcement and always maintains heavy patrols along the I-95 corridor which splits the county in half. This very aggressive presence may have something to do with the slow growth for Camden County.

The Canon that shot the Sheriff’s deputy is pictured on the left. This clarifies why the shot was non-lethal to the officer. It was a simple point and click. The reason for the rapid response from so many law enforcement officials for this benign occurrence is unknown. Statements made by officer who made the initial traffic stop claimed that the officer whose picture was snapped by this Canon was in fear of his life and thought that it may of been a hand gun?!? (He refused to let us to film this interaction and was very insistent that we stop our video camera from rolling, while not stopping his in the patrol car.)

The reason we were only able to shoot an actual stop versus officers hiding in speed traps is still a mystery to us, since they have several locations across the county in which they sit and wait to pull over speeding motorist. We do know that it did not take four police cars for them to confirm that we were taking pictures of them in action. Maybe at some point the Sheriff’s department could put these officers to work cleaning up the areas of the county inhabited by drug dealers and zoning violations versus looking for fine revenue from passing motorists.

If you capture a pic of any police department in Camden county running a speed trap, please submit your photos and location to us for us to post. Obviously speeding (or recording the results of it) does not work in Camden County GA.

KINGSLAND, Ga. -- Gerri Shiree Waters ended up on the wrong side of the bars at the Camden County jail where until mid-afternoon Wednesday she worked as a corrections officer for about 18 months.

Sheriff Tommy Gregory fired Waters, 37, as Georgia Bureau of Investigation agents arrested her on felony theft by taking and misdemeanor theft by deception charges for pawning a handheld Sheriff's Office walkie-talkie at the Pawn Place in Kingsland pawn shop.

Waters is accused of stealing the 16-channel radio valued at $750 and pawning it for about $50 cash. GBI agents recovered it during the five-hour investigation Wednesday.

Gregory asked the GBI to investigate when the pawn shop owner alerted him that morning upon discovering the walkie-talkie in his store's inventory, said Mike McDaniel, special agent in charge of the GBI's Kingsland office.

A store employee had taken in the radio for pawn earlier without realizing it was Sheriff's Office property, McDaniel said.
Because the investigation is ongoing, McDaniel declined comment about the possible motive in the case.

There is a shocking movement underfoot in our community. Recent criticisim of our navy base commander and his support of Sheila McNeill as a lobbyist for Kings Bay Navy Base was expressed in a letter to the editor last week. Today I heard that it was also posted on a local blog that is known for trashing local leaders and business people. The anonymous bloggers are apparently urging people to boycot Sheila’s Hallmark due to her successful lobbying and work as a member of the Camden Partnership. Not that I put much stock in the bloggers’ campaigns, but this is such an unethical effort, that I have been urging people to show their support for Sheila, who has done so much for this community, and worked so hard to maintain our level of military missions at our base. We as business people know what this community will be if the base ever leaves or severly reduces the missions at Kings Bay. Her business, like ours, has been suffering in this economy. I am asking you to show your appreciation and support of Sheila’s local business as a thank you for her sacrifice over the years to keep our community solvent with our number oneemployer, Kings Bay Navy Base. Executive session is used for three main reason to discuss litigation, personnel, or real estate.

These reason were put in the open records act to cover lawmakers butts. They made the law and they use this law. What they also did was include the word "MAY" when referring to when they could go into executive session.

Let's take a look at some of things St Marys used executive session for...

Personnel: Well one name comes to mind her Janet Brinko, That executive session will cost the city 1 million dollars!!!!

Real Estate: Well only one thing comes to mind on that, Gilman Boathouse!!!!!!!

That cost the city 1.3 million, maybe more since there will probably be some legal issues involved with how the purchased it and the fact that others had offered to buy it.

Litigation: This is were they will be spending alot more executive session time in the coming months. And let's face it if their attorney does not know that the city can be investigated by the grand jury, maybe it is time to find a new attorney!!!!!!

If they would end executive sessions and do the peoples work in public we would have to meet in private behind closed doors and be sued by it's people.

Bill Smith Corruption Case Has Been Closed. Cites Lack Of Funds!!!

When Barrack Obama appointed a new U.S. Attorney in Savannah, we all thought he would continue the corruption case against Bill Smith. One person I talked to yesterday at the U.S. Attorney's office in Savannah told me that the new U.S. Attorney was hoping the case would be able to just "go away", and he would not have to do anything. But according to this person the weekly phone calls wanting to know the status of the case kept the case on the front burner. Now that the case keeps being brought up every week the NEW U.S. Attorney has declared that is not even money to prosecute Bill Smith.

Even though the Justice Department found that he misspent money and demanded the TAXPAYERS of Camden County pay it back, there is not enough money to prosecute him.

Justice once again has not been served and this time it's due to lack of money.

I say print the damn money and PUT SMITH IN JAIL WERE HE BELONGS!!!!!

Students Said 10-Year-Old Had Stolen $5

NAHUNTA, Ga. -- A Georgia lawyer said he might sue the Brantley County School District over an alleged strip search of a 10-year-old girl.

The lawyer said the search was done at Nahunta Elementary School in May after other students said the girl had stolen $5.

He's filed a claim for $150,000 and said if the claim is denied, he will file a federal civil rights lawsuit.

According to the school district's policies, searches are allowed if there's a suspicion that a student has items like weapons or drugs.

The lawyer said a $5 bill doesn't fall in that category and that the district policy doesn't allow for intrusive searches.
The school district has not commented on the potential lawsuit.

The Nassau County deputy who was cleared of wrongdoing last week in the September shooting of an unarmed man has gotten a new assignment: narcotics detective.

Deputy Ernie Cole was assigned to patrol on Sept. 11, the night he fatally shot Franklin “Ray” Bodden, 39, during a traffic stop. The State Attorney’s Office and the Florida Department of Law Enforcement investigated the shooting and determined last week that it was justifiable homicide and Cole was not criminally responsible for Bodden’s death.

The five-year veteran of the force was returned to duty as a narcotics detective, Sheriff Tommy Seagraves said, a job he sought before the shooting.

“This is a lateral move,” Seagraves said. “This is not a promotion.”

Detectives are considered the same rank as a deputy, and Cole did not receive a pay raise, Seagraves said.

Seagraves said Cole has expressed remorse for what happened and has been subject to a lot of harsh language and thinly veiled threats since the shooting. Nothing has risen to the level of criminal conduct that would require an investigation, Seagraves said.

But family members said they feel the deputy was rewarded. Chuck DeYoung, Bodden’s brother, was with a group protesting in front of the Sheriff’s Office for much of Tuesday.

“Kill my brother and you get a promotion,” DeYoung said.

The shooting occurred while Cole was patting down Bodden’s friend after pulling them over for speeding on Bodden’s motorcycle. A new hire at the correctional facility, David “Bo” Bright, was riding along as a civilian and had a flashlight trained on Bodden, who put his hand in his pocket. Bright yelled at him not to move and shouted that Bodden had something in his hand. Cole shot Bodden twice. The object in his hand turned out to be a tightly wrapped package of marijuana.

DeYoung doesn’t buy the idea that Cole’s reassignment doesn’t amount to a pat on the back, even if there isn’t a raise involved.

“I don’t believe anything they say anymore,” he said.

When told about the family’s reaction, Seagraves said he wasn’t going to comment on anyone’s feelings.

“I run the Sheriff’s Office, and I run it based on what’s in the best interest for this community,” Seagraves said.

DeYoung and Seagraves had a public discussion last week at a news conference, when DeYoung pressed him for answers on why his brother was killed. DeYoung said it was the first time his family had any contact with the department, and they hadn’t heard from anyone since.

Corruption in High and Not So High Places

Cash for Clunkers

This is a story of ethically challenged characters who conspired to win a lawsuit with a potentially large cash payoff.

It involves a cub lawyer who violated Georgia Bar1 Association Code, an aggressive Chief Judge of the Glynn County Superior Court, who has a vested interest in her son’s financial success, and a Clerk of the Court whose salary is dependent on the good graces of the Chief Judge and who also writes orders for another Superior Court Judge.

This clique was successful in overturning key decisions handed down during years of prior litigation.

Chief Superior Court Judge Amanda F. Williams is the mother of Nathan Williams a junior attorney in Glynn County, Ga. Judge Williams owns the office that Mr. Williams uses and has a financial interest in his success. Judge Amanda Williams has asked attorneys in our community to send business to her young son.

In addition Judge Williams has intimidated a lawyer to withdraw representation of a long standing client who is being sued by Nathan Williams.

Judge Williams has important say in the compensation of her law clerk, Mr. Edward R. Zacker, for whom she obtained a $4,000 a year raise by special request to the Glynn County Commission.

Judge Williams is known to be an imperious person who has earned a reputation for aggressive and arbitrary behavior in her courtroom. Because of her impulsive conduct Judge Amanda Williams is the most reversed Superior Court Judge in the Glynn County Court System.

Mr. Edward R. Zacker serves as a clerk for Judge Amanda Williams and also serves as clerk for Judge E. M. Wilkes III for whom he writes orders. Mr. Zacker misrepresents his status to the State Bar of Georgia as an “inactive member” when he actually is an “active member”. In which case Mr. Zacker would be obligated to pay over twice the dues that he currently pays to the State Bar of Georgia and would also be required to keep his continuing legal education skills in ethics and professionalism current. This should have prevented the conduct that resulted in his crafting an order of contempt after Nathan Williams had bombarded Judge Wilkes with letters over a period of eleven months. Not only are members of the State Bar of Georgia governed by its rules of conduct, members are charged with the responsibility of reporting any misconduct.

In this case not only was Nathan Williams operating under a concealed contingency agreement* with his client, he also made false statements to the court relating to the use of an alias by the plaintiff.

In addition, Mr. Edward Zacker had series of discussions with the presiding Judge about a case that excluded the presence of the defendant’s attorney Mr. Millard Farmer. After a hearing on the motion for contempt and before the order was presented to Judge E. M.Wilkes for execution, Nathan Williams also communicated with Mr. Edward R. Zacker about issues in the case in the absence of counsel for the defendant Joe Iannicelli. This communication deprived Joe Iannicelli of the opportunity to have the court accord him statutory and constitutional rights. It should be noted that Zacker’s order also failed to address issues of dormancy and use of a false alias by Williams’ plaintiff (Joyce Head) raised by defendants attorney.

The combined interaction of Nathan Williams, Chief Judge Amanda Williams and Edward Zacker resulted in Mr. Zacker, acting as law clerk of Judge E.M. Wilkes III, to write an order on February 18th, 2009 holding Joe Iannicelli in contempt of court and subject to incarceration. Mr. Zacker’s order reversed rulings of three previous Judges which refused to hold Joe Iannicelli in contempt for not paying alimony.

It is ironic that the first time this issue was litigated 30 years ago Judge Robert L. Scoggin handed down a decision that Joe Iannicelli was not in contempt of court for not paying alimony to the plaintiff Alma Joyce Head because “just cause existed for arrearage” and the plaintiff “could not enforce by contempt and order that she herself was defying”. In other words plaintiff did not have “clean hands” because she abandoned custody of two teenaged sons. Mr. Iannicelli’s attorney in that case was Mr. James Williams, father of Nathan Williams and husband of Chief Judge Amanda Williams.

The ruling of Judge Wilkes reversed the orders of at two other Superior Court Judges over a period of about 25 years that they would not hold Joe Iannicelli in contempt for not paying alimony because the defendant’s ex-wife violated the divorce decree when she abandoned custody of two teenage sons. Her conduct deprived her of any rights to a contempt citation.

In retrospect, considering the pressures and influence of Judge Amanda Williams, Nathan Williams and Edward Zacker, it is almost inconceivable that Judge Wilkes would not give Nathan Williams what he wanted, which was a verdict of contempt and incarceration crafted by Zacker.

The same outcome could be expected for other defendants sued by Nathan Williams in cases brought before Judge E.M. Wilkes III. It should be pointed out that Chief Judge Amanda Williams has a great deal of authority in the assigning of cases to Glynn County Superior Court Judges.

* Nathan Williams was given this case by Anthony Harrison (now Judge Harrison) who also sued Mr. Iannicelli under a contingency agreement with Ms. Head. Judge Amanda Williams supported Mr. Harrison during his campaign for Judge. Mr. Harrison was not successful in persuading Judge White to incarcerate Mr. Iannicelli in November, 2000.

YULEE — A state investigator has told the family of an apparently unarmed Callahan man slain by a deputy Saturday night that he intends to review the patrol car’s video for evidence, but no details about what’s on the video or related matters have been released.

Sheriff Tommy Seagraves broke his agency’s silence about the shooting in an afternoon news conference Tuesday but gave few new details. Seagraves had refused to comment after turning the case over to the Florida Department of Law Enforcement, whose officials have also declined to release details.

Seagraves wouldn’t discuss the reason for the traffic stop that led to the death of motorcyclist Franklin “Ray” Bodden, 39, or any circumstances involving Deputy Ernie Cole’s decision to shoot Bodden. Bodden’s sister, Melissa Bodden, told the Times-Union Tuesday night Bodden’s passenger, Tony Weeks, told her from jail the stop was made for speeding. She said she believes her brother was reaching for his cigarettes when he was shot.

Seagraves said he is waiting for the FDLE’s investigation to be complete before he proceeds with his own.

“Sometimes officers have to make … split-second decisions,” Seagraves said. “We do offer our sorrows at this occurring. It’s not something we wanted to see happen.”

Seagraves said he has not seen the tape from Cole’s car.

Bodden’s family has complained about a lack of information, though Seagraves said he’s released everything he could to the family.

“They haven’t had the decency to come down here to tell the family what happened,” said Chuck DeYoung, 55, Bodden’s brother. “I want the truth.”

Seagraves said Cole was placed on administrative leave following the shooting, which occurred after Cole stopped Bodden and Weeks in a commercial area of U.S. 1 in Callahan.

Also in Cole’s car was David Bright, a detention deputy, Seagraves said. He said Bright was riding with Cole as part of the agency’s civilian observer program.

Seagraves said Cole began his work as a corrections officer before moving to patrol. He called Cole a good deputy. He said Bright was hired a week before the shooting.

An FDLE spokeswoman said she didn’t expect the investigation to be completed for at least several weeks.

Bodden’s family said they were told by Weeks that Bodden was shot after Bright yelled out to Cole that Bodden was reaching for something in his pocket. Weeks said he witnessed the shooting from the hood of Cole’s car, where he was being handcuffed after Cole found some type of pill in his possession.

Melissa Bodden said she talked to Weeks on Tuesday night at the Nassau County jail, where Weeks is being held on charges of resisting arrest without violence and possessing drugs without a prescription.

Bodden said her brother and Weeks, his best friend, were riding on Bodden’s motorcycle to a pool hall when the shooting occurred. She said Bodden and Cole apparently knew each other. She said a witness to the traffic stop said Bodden and Cole shook hands moments after the motorcycle was pulled over in front of the pool hall.

Bodden said Weeks told her Bright called out to Cole, “He’s going for something.” She said Weeks told her Cole ordered her brother to stop, then shot him twice in the chest.

Bodden’s family said he did not own a gun and was unarmed at the time of the slaying.

A viewing for Bodden will be held Friday from 6 to 8 p.m. at the Nassau Funeral Home, 541720 U.S. 1. His funeral will be Saturday at 11 a.m. at Freedom Hall, 54233 Plantation Road.

Callahan Deputy Highly Praised By Sheriff!!!

Callahan Gains Deputies

Sheriff T.L. “Tommy” Seagraves, Jr., and Mayor Shirley Graham announced today that Deputies Ernie Cole and Ray Rhoden are now primarily working within Callahan. Specifically assigning deputies to Callahan and Hilliard was a project both the mayor and the sheriff have worked on for more than five years.

Sheriff Seagraves reported that a grant is paying for officers’ salaries and equipment in both Hilliard and Callahan. This grant will cover their activities for the next two and a half years.

He said that both towns will retain their existing substations. Deputies assigned to Hilliard and Callahan will primarily work those towns but will be available to assist other officers during emergencies.

Both deputies, born in Callahan, have been in the department for some time. Ernie graduated from West Nassau High School in 2003 and Ray in 1992. Ray first became a police officer in 1999 in Fernandina Beach.

Sheriff Seagraves pointed out that he thought it important that officers familiar with Callahan be assigned. Mayor Graham said they were already have made an impact in town and have been meeting local businessmen.

St. Marys votes to fund more airport studies

Two councilmen say the project wasn't supposed to cost taxpayers.

ST. MARYS - City Council members voted 3-2 Monday to fund a new appraisal and a separate environmental study at the site of a proposed municipal airport near Woodbine.

Councilman Sidney Howell, who voted with Greg Bird against funding the studies, said it violates a non-binding referendum question that voters approved more than two years ago. The referendum gave city officials permission to relocate the airport under the condition no local taxes are used for the project.

"It's wrong spending money when the referendum said at no cost to taxpayers," Howell said.

The studies will now consider 600 acres that city officials said will be donated by a group that is the top bidder - so far - for Sea Island Co., which has declared bankruptcy.

The appraisal will also include more than 225 acres of wetlands never considered in the initial study, city officials said. The city's share for the two studies is $1,912.

Council members Deborah Hase, Chuck Trader and John Morrissey voted in favor of the motion. Keith Post, who has consistently voted for airport relocation, didn't attend.

Before the vote, Hase defended the recommendation to use local taxpayer money to fund the studies.

"The referendum still said to move it [the airport]," she said.

Earlier this year, council members approved a resolution 4-2 to use city funds for "incidental expenses" for airport relocation. Bird said the resolution allows city officials to disregard the voters' wishes.

"They gave themselves carte blanche on moving the airport," Bird said. "They put no limits on it."

Bird asked council members to delay the vote two weeks because the city has never published a Finding of No Significant Impact study, or FONSI, in the county's legal organ as the FAA requires.

The report was never published because city officials voted to abandon airport relocation in February 2007, a month before the study was released. Eleven months later, a new city council decided to resurrect the airport relocation issue.

City Manager Bill Shanahan said the city is not required to publish the study in the county's local newspaper because it was published in a federal publication that he did not identify.

But Bird disagreed, reading from a March 2007 letter from the FAA.

"In accordance with FAA procedures, the FONSI must be made available to the public," Bird read. "The enclosed notice must be placed in a local newspaper as soon as possible and run for a minimum of three days."

Bird said it's important for the public to understand the impact a new airport could have on the environment.

"We don't know the significance of the project," Bird said. "We need to find out exactly what we're dealing with [regarding] environmental issues."

Hase disagreed, saying the FAA understands the issues surrounding the project.

"It doesn't hurt to move forward," Hase said. "We need to keep moving with this project."

Sheriff Tommy Seagraves plans to break his agency's silence about the shooting during a 3 p.m. press conference today. Seagraves has refused to comment after turning the case over to the Florida Department of Law Enforcement, whose officials have also declined to release details.

The siblings of Franklin "Ray" Bodden, 39, said an FDLE investigator told them that Deputy Ernie Cole's vehicle was equipped with a video camera and that evidence would become part of the investigation.

Chuck DeYoung, Bodden's brother, and Melissa Bodden, their sister, told The Times-Union this morning the investigators said he would contact them with more information, but hasn't so far. Bodden's family has complained about the lack of information released in the case.

"They haven't had the decency to come down here to tell the family what happened," DeYoung said of the Sheriff's Office. "I want the truth."

FDLE spokeswoman Kristen Chernosky said Cole was placed on administrative leave following the shooting, which occurred after Cole stopped Bodden’s motorcycle in a commercial area of U.S. 1 in Callahan.

Also in Cole's car was David Bright, who had just been hired by the Sheriff's Office as a corrections officer, Chernosky said. She said she wasn't sure why Bright was riding with Cole.

DeYoung said he talked to Weeks by phone Monday from the Nassau County jail, where Weeks is being held on charges of resisting arrest without violence and possessing drugs without a prescription. DeYoung said Weeks told him that Bodden had either raised his hands or was raising his hands when he was shot twice in the chest.

Bodden said her brother and Weeks, his best friend, were riding on Bodden’s motorcycle to his parent’s home to spend the night when the shooting occurred. She said Bodden and Cole apparently knew each other. She said a witness to the traffic stop said Bodden and Cole shook hands moments after the motorcycle was pulled over in front of a local pool hall.

Bodden said she believes her brother was only reaching for his cigarettes when Bright called out to Cole, “He’s going for something.” She said her brother was shot twice in the chest and fell face down.

Bodden's family said he did not own a gun and was unarmed at the time of the slaying.

DeYoung said funeral arrangements for his brother should be completed by this afternoon.

ATKINS, Senior District Judge:

The City of St. Marys appeals from an adverse verdict in consolidated section 1983 actions which were based upon allegations that the city knowingly approved a pattern of improper police conduct consisting of acts of violence, intimidation, and humiliation.1 Appellant maintains that the evidence was insufficient to prove a policy or custom establishing the city's fault regarding the constitutional deprivation of plaintiffs' rights. In addition, appellant maintains that plaintiffs were not denied due process because adequate state remedies exist.2 Because we find that the evidence supports the verdict, and that the existence of a state remedy does not bar a section 1983 action of this type, we affirm.

* There was sufficient evidence before the jury from which the following facts could be inferred. On July 22, 1983, plaintiffs, Fowler and Depew, began repairing a customer's jeep at Fowler's garage. After completing the repairs at 1:30 a.m. the next day, plaintiffs took the jeep for a test drive. Fowler noticed a problem with the steering, so he allowed the jeep to veer to the right on two occasions and was subsequently stopped by Officer Kusek.

Fowler explained what he was doing, but was told he had to submit to a sobriety test although none of the officers detected any alcohol odor on his breath. Fowler readily agreed to take the test. Later, a lab report showed negative alcohol content.

While Kusek went to his car, apparently to obtain the test equipment, Fowler sat down in the jeep. When Kusek returned to the jeep, he grabbed Fowler around the neck and tried to drag him from the jeep. Fowler clung to the steering wheel, because he was surprised and frightened. When Kusek was unable to drag Fowler from the jeep, he demanded Depew's assistance. Depew, however, refused to interfere in any manner.

After a short while, several other officers arrived at the scene. One officer held Depew at gunpoint while he was handcuffed. Other officers helped Kusek drag Fowler from the vehicle. Then, Fowler was thrown to the ground and beaten by the officers before he was handcuffed. Depew was taken directly to jail, while Fowler was taken to a hospital for blood tests.

Plaintiffs subsequently filed these actions against the city and other parties. Plaintiffs alleged that their civil rights were violated due to the use of excessive or unreasonable force by the city's police officers. Liability was asserted against the city based on allegations that the mayor and city council had knowingly established a policy or custom of police misconduct. During trial, the evidence revealed several prior incidents of police misconduct. The evidence also indicated that the city failed to train, supervise, and discipline its police officers as required.

Ms. Donini testified that she had been harassed and forcibly placed in a police car by the city's officers during their apprehension of a suspect on her property in 1981. When she complained of a violation of her rights, she was informed that she had no rights. Moreover, her complaints were largely ignored by the mayor and council members. In fact, the city commended the officers for their actions.

Ms. Crumbley, a council member since 1979, testified that the council was aware of the Donini incident and another incident involving Michael Dixon. Mr. Dixon had also initiated a lawsuit alleging police brutality. Crumbley denied that the officers acted improperly, and maintained that these cases were settled merely to preserve peace in the community.

Mr. Dyals, a council member since 1980 and former chairman of the police subcommittee, stated that he was unaware of any investigation or disciplinary measures regarding the Donini or Dixon matters. Similarly, when questioned about another incident involving David Chaney, he could not remember any investigation regarding the matter.3

Councilman Saunders initially testified that no action had been taken by the council in the Donini and Dixon matters; however, he later testified that the Donini matter had been investigated. He stated that the council concluded that the officers had acted correctly. He also admitted that no action had been taken to alter police policy.

Additional evidence indicated that other complaints of police misconduct existed. Officer Ring remembered a complaint involving Officer Murray, but could not recall the details. Similarly, Officer Wiggins, a former training officer, was disciplined when he struck a handcuffed prisoner for no apparent reason.

The evidence relating to the lack of proper training, supervision, and discipline consisted of various personnel evaluation reports, employee warning reports, directives promulgated by Chief Keele, and the testimony of various witnesses. For example, Officer Ring was never disciplined other than by verbal reprimand although he had been cited for poor and improper work on many occasions. Similarly, while Officers Halley and Kaser were known to be hot tempered, both officers remained on patrol duty.

Chief Keele admitted that he had disciplinary problems with his officers. Nevertheless, he did little to rectify the problem. In fact, he stated, "At six bucks an hour, you take what you can get."

While the parties presented conflicting evidence, testimony indicated that the officers received inadequate training concerning the use of force in any given situation and when the use of deadly force was proper. Officer Sanders testified that no instructions on this subject were issued by the department. Moreover, Sanders candidly stated that excessive force was used against Fowler, but that it was nothing that he had not seen before.

The evidence also demonstrated that officers had little incentive to learn the policy and directives of the police department. If an officer failed an examination on the department's policy and directives, he remained in the same position, with the same duties, and he received the same wages. His sole penalty was that he was not promoted to a higher rank.

The mayor and council showed no inclination to change police policy. In fact, while the mayor and council members were aware of prior complaints of excessive force, they continued to assert that the department's supervision was satisfactory and that the officers were doing a good job.

At the conclusion of plaintiff's case, defendants moved for a directed verdict. The motion was denied. After the jury returned a verdict against the city, defendants moved for judgment notwithstanding the verdict. Finding the evidence sufficient to support plaintiffs' claims, the district judge denied this motion as well.II

The City of St. Marys contends that the evidence was insufficient to support the jury's verdict which was based on a finding of custom or policy on the part of the city resulting in plaintiffs' injuries. When considering the sufficiency of the evidence, this court must consider the evidence in a light most favorable to the plaintiffs and give them the benefit of all inferences which the evidence supports. This court must affirm unless it is convinced that there is a complete absence of probative evidence supporting the verdict or that the evidence so overwhelmingly supports the city that reasonable men in the exercise of impartial judgment could not render a verdict against it.

Section 1983 generally makes every person liable for conduct which deprives any citizen of the United States of any right, privilege or immunity secured by the Constitution. 42 U.S.C. Sec. 1983 (1982). For purposes of this statute, municipalities are persons. Monell v. Department of Social Services, 436 U.S. 658, 98 S.Ct. 2018, 56 L.Ed.2d 611 (1978). Section 1983 provides a fault-based analysis for imposing municipal liability; therefore, plaintiffs must establish that the city was the person who caused them to be subjected to their deprivation. To establish a policy or custom, it is generally necessary to show a persistent and wide-spread practice. Moreover, actual or constructive knowledge of such customs must be attributed to the governing body of the municipality. Normally random acts or isolated incidents are insufficient to establish a custom or policy. Bennett v. City of Slidell, 728 F.2d 762, on rehearing, 735 F.2d 861 (5th Cir.1984) (en banc). However, the custom need not receive formal approval. Monell, 436 U.S. at 691, 98 S.Ct. at 2036.

In this case, while the city provided rules and regulations for the operation of its police department, these rules were violated on numerous occasions. The city, however, failed to rectify the situation. The evidence revealed several incidents involving the use of unreasonable and excessive force by police officers. Therefore, the city had knowledge of improper police conduct, but failed to take proper remedial action. The continued failure of the city to prevent known constitutional violations by its police force is precisely the type of informal policy or custom that is actionable under section 1983. See Herrera v. Valentine, 653 F.2d 1220, 1224 (8th Cir.1981); See also Turpin v. Mailet, 619 F.2d 196 (2d Cir.), cert. denied, 449 U.S. 1016, 101 S.Ct. 577, 66 L.Ed.2d 475 (1980).III

Appellant maintains that plaintiffs failed to state a claim under section 1983, because they had an adequate remedy under state law and were not denied due process. Plaintiffs can pursue claims for false imprisonment, false arrest, and assault and battery in state court. Since state law provides plaintiffs with these post-deprivation remedies, appellant asserts that plaintiffs have received all the process which they are due under the Fourteenth Amendment.

Parratt v. Taylor, 451 U.S. 527, 101 S.Ct. 1908, 68 L.Ed.2d 420 (1981) is the starting point for discussion. Parratt involved a section 1983 suit for damages of $23.50 brought by an inmate for the negligent deprivation of property without due process of law. The court concluded that the due process clause was not violated because plaintiff had an adequate state remedy. A pre-deprivation hearing was not practical and a post-deprivation hearing was available. Id. at 543, 101 S.Ct. at 1916. The court emphasized the need for this result. Otherwise, every injury caused by a state official under color of law would constitute a due process violation and would be actionable under section 1983. Id. at 544, 101 S.Ct. at 1917. Justices Stewart and Powell concurred, because they did not believe the claim rose to the level of a deprivation of property under the Constitution. Id. 544, 546, 101 S.Ct. 1917, 1918. Justices White and Blackmun emphasized that the opinion was limited to deprivations of property and did not encompass deprivations of life or liberty. Id. at 545, 101 S.Ct. at (White and Blackmun concurring).

In Hudson v. Palmer, 468 U.S. 517, 104 S.Ct. 3194, 82 L.Ed.2d 393 (1984), the court dealt with an intentional deprivation of property through an unauthorized act by a state employee. The court extended the holding in Parratt to include intentional deprivations of property where it was impractical to hold a pre-deprivation hearing and where an adequate state remedy existed. The court's holding, however, was based on the fact that the action was unauthorized.

We reasoned that where a loss of property is occasioned by a random, unauthorized act by a state employee, rather than by an established state procedure, the state cannot predict when the loss will occur.

Id. 104 S.Ct. at 3203. The Court reasoned that while the action was under color of law, the unauthorized acts were beyond the control of the state. The Court then discussed Logan v. Zimmerman Brush Co., 455 U.S. 422, 102 S.Ct. 1148, 71 L.Ed.2d 265 (1982). In Logan, the court reaffirmed Parratt but distinguished it.

We specifically distinguished the case from Parratt by noting that "Parratt ... was dealing with a ... 'random and unauthorized act by a state employee ... [and was] not a result of some established state procedure.' " Parratt, we said, "was not designed to reach ... a situation" where the deprivation is the result of an established state procedure.

Hudson, 104 S.Ct. at 3203 n. 13 (footnotes omitted).

Gilmere v. City of Atlanta, 737 F.2d 894 (11th Cir.1984), rev'd, 774 F.2d 1495 (11th Cir.1985) (en banc) is the critical Eleventh Circuit decision regarding this issue. In Gilmere, plaintiff's decedent was killed by police officers during arrest. The court ruled that the state survivor tort remedy was all the process that was due because the conduct was random and unauthorized, and a pre-deprivation hearing was impractical. The court then extended the holdings of Parratt and Hudson to include negligent and intentional deprivations of liberty. The court avoided ruling on whether the same result would have been proper for a violation of substantive due process. In fact, the court specifically stated:

Thus our holding today is in line with Duncan v. Poythress, 657 F.2d 691, 704 (5th Cir.1981) where the plaintiff's claim was held to be not barred by Parratt because it was based on the substantive due process right to vote. Additionally, the acts of the police here, although most unfortunate, did not "offend those canons of decency and fairness which express the notions of English-speaking peoples even toward those charged with the most heinous offense" or "shock the conscience," so as to violate the substantive due process guarantees "implicit in the concept of ordered liberty."

Id. at 910 (citations omitted).
Upon rehearing, the court stated:

We accepted this case for en banc consideration primarily to determine whether Parratt v. Taylor precludes a claim by his administratrix under 42 U.S.C. Sec. 1983 because state tort law provides a comparable remedy.
Gilmere, at 1496 (citations omitted). The court concluded that plaintiff's action was not barred.

Having thus found that the scope of Parratt is necessarily limited by both the legislative history of section 1983 and the Supreme Court's own pronouncements, we perceive at least two alternative constitutional theories ... on which this plaintiff may predicate her section 1983 claim for relief against the police officers.
Id. at 1499.

In Gilmere, the court articulated two theories which allow injured parties to bring actions pursuant to section 1983 regardless of whether an adequate state remedy was available. First, an individual can maintain a section 1983 action whenever the government's conduct violates substantive due process. Id. at 1501. Similarly, an individual can bring a section 1983 action based upon Fourth Amendment violations. Id. at 1502.

Here, the jury determined that the City of St. Marys had implicitly ratified a custom or policy permitting the police to use excessive force against its citizens. The use of "excessive" force in making an arrest constitutes an unreasonable seizure. Therefore, the plaintiffs are entitled to maintain a section 1983 action in spite of the existence of any state remedies.4

The evidence was far from overwhelming, but it was sufficient to support the jury's verdict. The jury was entitled to draw all reasonable inferences from the evidence and evaluate the credibility of the witnesses. The evidence revealed sufficient prior incidents where the police had used excessive force to put the city on notice. Yet, the city failed to take proper remedial action. This evidence was sufficient to support a finding that the city's officials implicitly ratified a custom which resulted in plaintiffs' injuries. Based on this evidence, the plaintiffs are entitled to maintain a section 1983 action in federal court regardless of the existence of any state remedy. Thus, we AFFIRM.

O'Neal, 254 Ga. 390, 330 S.E.2d 95 (1985) has settled this issue. The defense of sovereign immunity is waived to the extent of the municipality's liability insurance coverage. Id. Neither Acker v. City of Elberton, 176 Ga.App. 580, 336 S.E.2d 842 (1985) nor any of the cases cited therein are relevant. The implied holding of Acker is that a municipality is not liable for the torts of police officers under a theory of respondeat superior. No such limitation on liability exists, however, when the officer's conduct is based on a city's custom utilizing excessive force to control its residents

A house fire on the afternoon of January 6, 2006, on Lynwood Street in Kingsland severely burned a one-year-old boy and nearly took the life an elderly woman. Investigators believe the fire started at about 4:00 p.m. in the crib of the infant boy after his mother left a burning candle on a dresser beside his crib. The child was left in the crib unattended.

The mother, and owner of the residence, Jennifer Lynette Brown, 24, told investigators she was standing outside the residence when she heard her child screaming. She and a neighbor went into the residence, extinguished the fire and brought out the child. He was transported by air ambulance to Shands Hospital in Jacksonville, Fla., then transported to Shands Burn center in Gainesville, Fla., with first and second degree burns over 30 percent of his body.

The responding deputies, Dep. Robert Godley and Dep. Richard Riggle, asked Brown three times if anyone else was in the residence before she told them her grandmother was still inside. At that point Godley and Riggle entered the smoke-filled home and found, Shirley Durham, 72, incapacitated, but alive and unharmed, lying on a bed. The deputies picked up the mattress, left Durhan on it and carried her to safety.

Sheriff Bill Smith said he was proud of the deputies’ efforts.

“This is not something that deputies are called upon to do very often, but once they realized there was someone left in the home they did not hesitate to go in and get her. Dep. Godley and Dep. Riggle did an outstanding job and saved Mrs. Durham’s life. Our thoughts and prayers go out to the young child who was not as fortunate and burned very badly.”

The fire remains under investigation by the Sheriff’s Office and Camden County Fire Rescue.

Godley has been fired for his sexual addictions and accusses ME (Rick Rogers) for spilling the beans on him. Now his BFF Rich Riggle has a chance to get Rick, but NOT DOING A PROPER INVESTIGATION, MIGHT GET YOU FIRED!!

On May 26, 2010 Bill Shanahan and I were in a personnel session with Janet Brinko. During this meeting, Ms. Brinko became very upset about a letter of caution she was receiving and said she didn’t understand why she was getting a memo and further stated that Alyce Thornhill should be in trouble for disobeying a directive from Mr. Shanahan. She went on to say that Ms. Thornhill had contacted Jolene Haney to discuss the possible pros and cons of consolidating the St. Marys Tourism Dept and Economic Development Department. When the City Manager asked how Ms. Brinko became aware of this, she stated that Jolene Haney had contacted her and informed her that Ms. Thornhill had contacted her (Ms. Haney) about the possible consolidation.

At that time, the City Manager stated that he would look into it further. Ms. Brinko stated that Mr. Shanahan should contact Ms. Haney right now on the phone to confirm the information. Mr. Shanahan stated he did not conduct investigations that way and let Ms. Brinko know he would be contacting Ms. Haney at a later time during his investigation.

St Marys PD Opens An Investigation

ARE THERE BAD COPS IN ST. MARYS?

Yes it is true the SMPD has opened an investigation, not on anything at the courthouse, but on the whole incident investigation. I am saying that the investigation was flawed.

This is what I want to know from the City of St. Mary involving my case:

Who called 911?
In a dispute, don't you talk to both sides involved?
Do you allow an outside agency with no authority to come in and start barking orders at the SMPD?
Do walk over the injured to slap handcuffs on someone?
Do you document injuries to all parties involved, or just one side?
Why did Bob Godley's name come up time and time again?

These are just a few of the questions I hope are answered.

To all out there be careful when you call 911 in St. Marys, You might be the one going to jail.

We all know why I was arrested, and it had nothing to do the the doctors office, and everything to do with one of Bob Godley's friends who thinks he is God since someone was dumb enough to give him a badge.

Anthony Graber broke the law in early March is indisputable. He raced his Honda motorcycle down Interstate 95 in Maryland at 80 mph, popping a wheelie, roaring past cars and swerving across traffic lanes.

Anthony Graber was arrested for posting a video of his traffic stop on YouTube.But it wasn't his daredevil stunt that has the 25-year-old staff sergeant for the Maryland Air National Guard facing the possibility of 16 years in prison. For that, he was issued a speeding ticket. It was the video that Graber posted on YouTube one week later -- taken with his helmet camera -- of a plainclothes state trooper cutting him off and drawing a gun during the traffic stop near Baltimore.
In early April, state police officers raided Graber's parents' home in Abingdon, Md. They confiscated his camera, computers and external hard drives. Graber was indicted for allegedly violating state wiretap laws by recording the trooper without his consent.
Arrests such as Graber's are becoming more common along with the proliferation of portable video cameras and cell-phone recorders. Videos of alleged police misconduct have become hot items on the Internet. YouTube still features Graber's encounter along with numerous other witness videos. "The message is clearly, 'Don't criticize the police,'" said David Rocah, an attorney for the American Civil Liberties Union of Maryland who is part of Graber's defense team. "With these charges, anyone who would even think to record the police is now justifiably in fear that they will also be criminally charged."

Carlos Miller, a Miami journalist who runs the blog "Photography Is Not a Crime," said he has documented about 10 arrests since he started keeping track in 2007. Miller himself has been arrested twice for photographing the police. He won one case on appeal, he said, while the other was thrown out after the officer twice failed to appear in court.
"They're just regular citizens with a cell-phone camera who happen to come upon a situation," Miller said. "If cops are doing their jobs, they shouldn't worry."
The ACLU of Florida filed a First Amendment lawsuit last month on behalf of a model who was arrested February 2009 in Boynton Beach. Fla. Her crime: videotaping an encounter between police officers and her teenage son at a movie theater. Prosecutors refused to file charges against Sharron Tasha Ford and her son.

I recently met with Shelia Mc Neil and David Keating with respect to retaining our MMST in St. Marys. The Camden Partnership is planning to go to Washington to lobby for retention of this program. Since this program is vital to the well being of St. Marys they are planning to make several trips to DC for the purpose of retaining this unit. The city was asked to sponsor one trip at a cost of approximately $1,500. We can donate this money to the JDA to act as our consultant on this matter. Bill S. has checked our budget and advised me that there are funds available for this purpose. Both Camden Partnership as well as the JDA has been advised that our sponsorship is to be used only for the MMST program.

Please let me know if you will support this effort ASAP. I will authorize this expenditure if there are no major objections.

Subject: MSST Lobbing Effort Funding

Mayor –

It is my understanding that you have the authority to authorize this expenditure, with or without our say-so. That being said, I do appreciate you wanting to know the thoughts of Council informally before you make a decision to expend City Funds.

I will defer to our City Attorney the issue Councilman Bird raised as to whether you can ask our opinion on an issue by email about a decision you want to make. I hope that is not wrong, for if it is not allowed, you and I having a conversation in the hallway about something will be the next thing to go. Soon we will have to drive down different roads to avoid being in the same proximity to each other.

I do want to make an important point as to Councilman Bird’s framing of this situation. I do not consider this request for financial support a ‘donation’ to the Camden Partnership. Sheila McNeill, as you know, is President of the Partnership and she has been the lead in this fight to stop the Obama Administration from cutting the USCG Budget which includes closing our MSST (Maritime Safety and Security Team).

I was asked by Council to be the lead man in the City’s effort to stop the closure of the MSST, and I do appreciate Councilman Bird's kind words in that regard to my service in that capacity. I have kept the council informed with periodic updates formally at Council meetings of the goings on both here and in DC. I have provided copies of letters to all of council that our Senators and Congressman have jointly signed with others from other parts of the country. This has not come about due to my efforts, this has come about due to the enormous amount of respect and accessibility Sheila is afforded on Capitol Hill, at the Pentagon and at Coast Guard Headquarters. As I stated to you earlier, at a national meeting of the Navy League In Washington DC the begin of this month, it was Sheila who was singled out and recognized by the new Commandant of the Coast Guard for our efforts. No one else from anywhere else in the country was afforded this recognition.

I consider this expenditure of $1500. a small investment in her efforts on OUR BEHALF on Capitol Hill, compared to the amount she has actually spent, not only in resources but in her time. I can tell you that I cannot afford to make all the trips she is making. I personally paid for my trip to Washington, DC as part of the Chamber Fly-In as the President of the Navy League in April where we visited with the Coast Guard at their HQ, and also had the opportunity to meet with CG Staff at a dinner. I helped write the letter you signed in support of our efforts, and I wrote and signed a letter to the Commandant as President of the Navy League.

This is a fight we must win. To question making a $1500. investment to assist in the expenses of trips to DC that Sheila is making to lobby on our behalf, when we stand to lose $231,000 in rent alone as a city not to mention the 8 Million Dollar impact to our county and area, is almost ludicrous. The partnership has asked Kingsland and Woodbine for support as well, and how embarrassing will it be for us if they make a commitment before we do. This is the right thing for us to do.

I hope you will move forward to assist the Partnership in their efforts to save our MSST.

Meet Jason Spencer Republican For GA. State Rep. District 180

Jason was born in 1974 to a military family on Offutt Air Force Base in Nebraska. His family moved to Moody Air Force Base in Valdosta, GA in 1978 and a year later moved to Alapaha, GA where he and his three siblings grew up.

Growing up in rural South Georgia to a modest family, he is no stranger to hard work. Jason’s summer jobs routinely consisted of picking peppers and cropping tobacco. In between his jobs and school work, he and his identical twin brother trained for hours in the South Georgia sun honing their tennis skills. Because of his dedication to the game he started college at ABAC and then transferred to Alabama State after securing a tennis scholarship. He then transferred to the University of Georgia in 1995, where he graduated with a Bachelors degree in Sports Medicine. Three years later Jason became a Physician Assistant graduating from South College in Savannah, Ga., and then obtained a Masters degree in Physician Assistant studies from the University Of Nebraska College Of Medicine.

In 2003 he married his wife Melaney and only two short years later had their first of two beautiful daughters, Madeline and Vera. Jason and his family have been living in Camden County, Georgia since 2005 where he currently practices both emergency medicine and works at a family practice clinic. Jason is also active in his community where he served two terms on his home owner’s association board of directors as its Secretary and President and is also an active member of his church, Agape Christian Fellowship. Jason enjoys spending his free time playing in the local tennis league and helping in the schooling of his children, as he and his wife have chosen to home school.

Although Jason has always been involved in politics as well as a student of history and economics, he became deeply involved in 2007 after recognizing the direction our country is headed. In response to the abandonment of free market principles after the panic of 2008 and bank bailouts, Jason could sit on the side lines no longer and he became involved in starting two coastal Georgia Tea Party movements. The impetus for his decision to run for the Georgia State House of Representatives was the recent government takeover of healthcare.

Jason recognizes that our government at the federal, state and local levels has been taken over by one party and that is the party of Big Government which no longer serves the will of the people.

The idea of upholding a constitutional republic, free markets and fiscal responsibility has been eliminated from our political foundation. These core principles are the bedrock of our economic freedom. Securing economic freedom is paramount to having individual freedom and the God given right to life, liberty and pursuit of happiness.

Jason believes the statement, “All politics is local”, has never been more relevant than it is today. It’s now time for the states to stand up to the federal leviathan and assert their sovereignty on behalf of their citizens. This is the only political remedy that is afforded to Georgians in the U.S. Constitution. To secure our freedoms, Jason’s goal is to uphold the Constitution in Atlanta to thwart off unconstitutional federal mandates and assure that the liberties of Georgia’s citizens are not trampled upon by our own state government.

What Jason Says:

• Support a Constitutionally Limited Government: I believe America and the Several States have strayed from our founding principles. The U.S. Constitution is the “North Star” for our Republic and we have taken our eyes off of it. The consequences of not following its direction have resulted in out of control Federal and State governments. Over the years the Constitution has been ripped to shreds by those who want our rights to come from a few men and not from our God or Nature. When elected, I will firmly stand to uphold the oath of the Constitution of the United States and the State of Georgia in order to guide us back to the foundation of freedom and assert State Sovereignty where needed.

• Taxes: Let’s face it. We have a “screwed up” tax code at all levels of government. We have excessive taxation that has become and extraordinary means of oppression. The power to tax is the power to destroy. If history is to be our guide in tax reform, there is no single tax Nirvana. A permanent tax system should be as indirect as possible. Taxes must not be excessive; i.e., not only what the people are able to pay, but what they are willing to pay. The whole tax system must be moderate: no savage punishments; no totalitarian intrusions; uniform and equal rates. When elected, I will seek to support legislation which eliminates the state income tax. Furthermore, I will consider the elimination of property taxes when a viable alternative is found. Until that option is found, I will work to keep this form of direct taxation at a minimum and governments will have to work with what is provided to them from the people.

• Support free markets and a sound monetary policy: Rediscovering the true meaning of free market capitalism is the key to economic recovery for the state and the district. Collusion between government and private corporations to bankroll private projects with the sole purpose of increasing the tax base is a moral hazard and distorts the free market. Supporting free market principles will bring back the much needed private sector jobs to the district. When elected, I will not support any legislation that enhances the ability of governments to pad the pockets of private companies for the purposes of gaining a new tax base. I believe in the separation of economy and state. Furthermore, I will work to protect the value of every Georgian’s hard earned money by allowing competing currencies such as gold and silver as allowed under the U.S. Constitution. Federal deficit spending continues daily devaluation of the paper money in our pockets. We have the right to protect the fruits of our labor.

• Education: Georgia’s education system is the largest budget expenditure and is one of the most important issues facing our citizens. If Georgia does not properly prepare its students for the new advances in our economy, we will create a dependent class begging for more entitlements. Our hard working teachers cannot be blamed for Georgia's standing of 46th among the 50 states, but leadership and failed programs can be. However, within Georgia, District 180 has one of the best public school systems in the state and we can be very proud of that—but, every school district has room to improve. As your representative I will support legislation that will return control of education to the local school board, thwart unfunded and unconstitutional federal mandates like No Child Left Behind and revise the QBE funding formulas to allow more flexibility within school boards.

• Sanctity of Life: Elective abortion is murder. Period. Protecting the individual rights of the unborn is the last frontier in the civil rights movement. Just as black Americans were once treated as a subclass of humans, so are the lives of the unborn baby. I will uphold the right of the unborn in order that they may be afforded the right to life, liberty and the pursuit of happiness.

• Second Amendment: No government shall infringe on our right to bear arms. I will support legislation that will protect any law abiding citizen of Georgia from having their firearms confiscated from government authorities. I will also support any legislation that would endanger or restrict your access to ammunition. It is your God given right to protect you and your family.

• Healthcare/ the Nanny State: As your representative, I will support and introduce legislation that will protect the rights of Georgia’s citizens from unconstitutional federal mandates that eliminate healthcare freedom and choice. Furthermore, I will oppose any legislation that imposes excessive state action under the guise of “protecting you” from the consequences of your actions which actually results in striping you of your freedoms and liberties. We must restore personal responsibility to our culture and demand the end of this “cradle-to-grave” mentality permeating our society.

In light of the Camden County Grand Jury's free pass given to school teachers who leave their guns in their UNLOCKED vehicles, the BOE is extending this privilege to all residents of Camden County.

One day only, Friday May 14, 2010.
Please feel free to pack guns, ammo, grenades, rocket launchers, and anything else you can fit into your car.
Remember, you must be a teacher, Because teacher has it's privilege!!

Now folks for those of you who can't see the humor, this really isn't going to happen.
I have to say that because there would be some dumb ex cop or teacher that would think I was serious.
But on to the serious stuff.

Even though the grand jury refuse to prosecute this teacher, and the law does state that the guns must be locked up inside the vehicle.

Here is the law the Grand Jury quoted:

O.C.G.A. 16-11-127.1(c)(17).

(17) Teachers and other school personnel who are otherwise authorized to possess or carry weapons, provided that any such weapon is in a locked compartment of a motor vehicle or one which is in a locked container in or a locked firearms rack which is on a motor vehicle;

and here is the punishment:

(b) Except as otherwise provided in subsection (c) of this Code section, it shall be unlawful for any person to carry to or to possess or have under such person's control while within a school safety zone or at a school building, school function, or school property or on a bus or other transportation furnished by the school any weapon or explosive compound, other than fireworks the possession of which is regulated by Chapter 10 of Title 25. Any person who violates this subsection shall be guilty of a felony and, upon conviction thereof, be punished by a fine of not more than $10,000.00, by imprisonment for not less than two nor more than ten years, or both; provided, however, that upon conviction of a violation of this subsection involving a firearm as defined in paragraph (2) of subsection (a) of Code Section 16-11-131, or a dangerous weapon or machine gun as defined in Code Section 16-11-121, such person shall be punished by a fine of not more than $10,000.00 or by imprisonment for a period of not less than five nor more than ten years, or both. A child who violates this subsection shall be subject to the provisions of Code Section 15-11-63.

But on a much bigger note, this teacher may get his job back as stated in the Times Union:

School administrators said they were surprised to learn Mortier had the weapons in his car, saying the zero-tolerance weapons policy applies to everyone, including students and staff.
But District Attorney Stephen Kelley said there has to be criminal intent to charge a teacher for a weapons violation on school property.
"Georgia law does not have a zero-tolerance policy," he said.
Will Hardin, superintendent of Camden County schools said he was "surprised" by the decision.
When told state law allows teachers to bring weapons onto school property, Hardin said he was opposed to the legislation. He said Mortier could conceivably apply for a teaching position but wasn't certain he would be hired.
"He resigned," he said. "We've never had this before. There was no precedent."

So you can see that Dr Will is going to have a huge problem.

I can tell Dr. Will how to fix this problem and hire this good teacher back.

End the zero-tolerance rules across the board. When you have zero-tolerance rules, there is no room for honest mistakes or for plain stupidity.

Camden County High teacher arrested after guns found on campus

KINGSLAND — Police arrested a math teacher at the Camden County High School Ninth-Grade Center Wednesday after finding guns, ammunition and a hunting knife in his vehicle on school property.
Police said school officials called about 8:30 a.m. and said other employees had told them about the weapons.
The teacher, Ralph Mortier, was called to an office and confronted about the weapons. When police accompanied him to his car, they saw a brown leather handgun belt and ammunition in plain view inside the vehicle, police said.

Officers also discovered a black nylon case lying on the back seat that contained a double-barrelled shotgun and shells, police said. A hunting knife and more handgun ammunition were also found in the vehicle.

Mortier, 42, of Kingsland, was charged with possession of weapons on school property and taken to the police department for questioning. He was later released, pending further investigation and presentation of the evidence to a Camden County grand jury.

School officials said Mortier has resigned. Nobody answered the telephone at Mortier’s home, and there was no answering machine.
Gary Blount, deputy superintendent of Camden County schools, said the arrest surprised him.

Mortier worked in the district for at least 12 years and was a tenured teacher who should have known about the district’s zero-tolerance policy for weapons on school property, said Blount, who has also been a Camden County High principal.

“It’s shocking they could bring anything on school grounds,” Blount said. “Every employee of the school should know the policy. No guns. That’s the state law.”

Blount said Mortier was a gun enthusiast but doesn’t believe the teacher intended to threaten or harm anyone. The district recently announced as many as 30 teachers will lose their jobs at the end of the school year because of budget cuts, but Mortier was not one of them.

“I don’t think Ralph would do anything,” he said. “I would not have picked him to do anything like that."

This story is about the Dallas Texas school district, but you will see there are many ways this compares to what is done here in Camden. Remember they have allowed teachers to quit or simply refused to renew their contract as a form of punishment for wrong doing. I myself have said that all they are doing is passing the bad apples on to another district.

My question is how many of these "BAD APPLES" are in our schools. We already know they don't have a problem hiring felons, we just don't know how many they have hired, because they will not discuss it.

We need to open up our BOE so the public knows who is teaching our children.

Dallas ISD teachers' misconduct with students was kept quiet

The author of the e-mail was a Skyline High School teacher. The recipient: her student.
Dallas school investigators determined last spring that teacher Leslie Michel Finch behaved inappropriately with the 17-year-old boy as early as December 2008, according to district records.
Ten months after the district completed its investigation, Finch was still employed as a teacher at Skyline before she decided to resign last month. In recent weeks, she became a substitute teacher in a Central Texas school district.
The case illustrates a pattern discovered in a Dallas Morning News review of 20 cases involving sex allegations against teachers from late 2005 to 2009 in the Dallas Independent School District. In about half of the cases, criminal charges were pursued. In the other half, educators suspected of inappropriate relationships with students were allowed to quietly resign and maintain clean criminal records, paving the way for them to continue working with children.
In nearly all of the cases, with the exception of Finch, DISD reported the allegations to the state, as is required, and most teaching credentials were revoked. But even so, educators without state credentials can work outside of the public school system, in day-care centers, recreation programs and private schools.
Dallas officials refused to comment on the situation or the specific cases. Finch also refused to comment.
"While we do not comment on personnel matters, the district continues to notify [the state] on a timely basis the names of teachers who have resigned from the district as a result of alleged misconduct as required by law," DISD spokesman Jon Dahlander said in an e-mail.
DISD trustee Edwin Flores did not address the cases or the overall situation but said if the district's case against a teacher reaches the school board in appeal, he does not support allowing teachers to resign.
"As one of the three panel members, if I'm asked if [I] will let the person resign instead of taking their medicine, I say, 'No, they're going to take their medicine.' "
Holes in legal nets
There are legal nets designed to catch cases such as Finch's, to make sure that trained police or child abuse workers evaluate whether a crime has been committed or whether an educator's name should be cleared.
Every school employee – from teachers to administrators to district leaders – is compelled by law to go to the authorities within 48 hours if sexual abuse is suspected.
In Finch's case, the allegations were not forwarded to TEA, and Dallas police were not notified.
Instead, an in-house school district investigative office, which looks at everything from employee ethics to fraud to district spending, determined that something inappropriate took place. And that's where things apparently ended.
Texas Education Agency officials said the district should have erred on the side of caution and reported the case to the state.
"We're definitely going to open up an investigation on this," said Doug Phillips, TEA's director of investigations and fingerprinting, after reviewing a DISD report obtained by The Dallas Morning News.
In its review, The News looked at hundreds of pages of records focusing on sex abuse allegations against educators that were collected over time with public information requests from the Texas Education Agency, the Dallas Police Department and school district investigations.
The most egregious incidents, usually involving intercourse, were pursued and criminal charges resulted.
But at least 10 cases resulted in no charges and ended with resignations rather than firings. They involved kissing, fondling, romantic e-mails and text messages, sexually charged phone calls and admitted inappropriate relationships with students.
Here are a few examples:
• Thomas Edward Hughes Jr., former teacher's assistant at Adamson High School, was found to have fondled and kissed a minor student in a school storage room, according to district records. He resigned and avoided criminal prosecution and is working at an area recreation center and as a coordinator for a mentoring program in several Dallas-area schools through his church.
• Thomas Jefferson High School teacher Cordelia Lakay Wilson admitted having a sexual relationship with a student after DISD investigators said they were found together partially undressed in a school office, according to district records. She was arrested after DISD police investigated, but the case was never filed with the district attorney's office.
• District records describe former Holmes Middle School teacher James R. Bunton as having inappropriate conversations about sexuality with a student and trying to get the child to spend the night at his home. He resigned and opened the private James R. Bunton Math & Science Academy in South Dallas last year.
No information could be found to indicate the former DISD employees faced criminal prosecution. Hughes and Wilson deny the allegations. Bunton did not return calls for comment.
Experts say Dallas ISD is far from alone in allowing some educators to resign rather than pursuing criminal allegations to the fullest extent of the law. And school districts often hesitate to let parents of other students at the schools know about potential issues, losing the chance for other victims to come forward.
"There are many school districts that still believe that the reputation of a school district is more important than the safety of children," said Kansas State University professor Robert J. Shoop, who has provided expert testimony in about 60 cases related to sexual misconduct by educators.
"I call these people 'mobile molesters,' " Shoop said. "I've worked with people who were in their third or fourth district molesting kids. Because each district they were accused or suspected in just allowed them to leave without challenging them."
What the law says
State law requires that any school employee who suspects child abuse, including sexual contact, report within 48 hours to the Department of Family and Protective Services or a law enforcement agency. Individuals who fail to report abuse can face criminal charges.
DISD policy requires that the employee also notify the district's Child Abuse Office.
Child Protective Services spokeswoman Marissa Gonzales said a vulnerable child is at further risk anytime an incident goes unreported.
"It's important that people know that it's not up to you to judge whether or not what you see or suspect was actual abuse," she said. "The important thing is you make the report and let professionals determine that."
Educators in public or private schools who have improper relationships with students can face felony charges. The law applies to any type of sexual intercourse and sexual contact, such as touching the breast or any part of the genitals, including through clothing, with intent to arouse. It's also illegal for an educator to solicit a student online.
Federal law also prohibits sexual harassment of students, such as unwelcome sexual advances, requests for sexual favors and other verbal, nonverbal or physical conduct of a sexual nature.
Yet it appears that for years, there has been a gray area for what has been considered bad enough to be sent on to police or pursued.
And even when cases are pursued by police, some sexual acts between teachers and students are not viewed as criminal by the justice system.
One educator mentioned in the records was mailed a Class C ticket, basically the equivalent of a speeding ticket, after he admitted to Dallas police that he'd kissed a student. Another received such a citation for touching students' rear ends.
The citations come with fines and don't require a court appearance. They also typically aren't revealed during criminal history checks because the alleged offender usually is not arrested.
Phillips, of TEA, said the low-level tickets make it difficult for future employers to detect past problems.
"It usually goes down to that useless Class C," he said.
Dallas police deputy chief Michael Genovesi, who supervises the units that investigate crimes against children, said his department has to abide by the Penal Code concerning Class C misdemeanors.
"The notion of a teacher having any kind of what you would view as inappropriate contact like that is going to irritate or upset the vast majority of parents," Genovesi said. "As far as what we can investigate or prosecute, we're going to be guided by the Penal Code."
TEA cases on the rise
Investigations of school employees having inappropriate relationships with students/minors are up statewide during the last fiscal year, according to an analysis of information from the Texas Education Agency, which began using a new system to track cases a couple of years ago.
Last fiscal year, the agency investigated 123 such cases – up from 86. Sexual misconduct investigations, which include sex assaults and fondling, also increased – to 218 last fiscal year from 169.
TEA spokeswoman DeEtta Culbertson said that better reporting, improved awareness of the crimes and more students coming forward are contributing to the higher numbers.
"Certainly, that's what we want," Culbertson said. "As sad as it is, it's still more important to know and to get anyone who is guilty of these types of offenses out of the classrooms."
No state or federal laws require other parents at the affected schools to be notified.
DISD's practice has been to keep sexual incidents private, even if the person is arrested, indicted and convicted. Those that became public were often uncovered by the media.
A current lawsuit against Dallas schools accuses school officials of playing a role in the alleged rape of a 14-year-old girl in 2008, contending that other students made complaints about former band director Calvin Beckton at Boude Storey Middle School and he remained at the school.
Beckton was indicted last January in two cases of sexual assault of a child, one involving the daughter of the woman who brought the suit.
DISD has denied any responsibility in court records. Beckton denies he sexually assaulted the teens and is awaiting trial.
In 2005, DISD trustees discussed a policy requiring parental notifications when educators are jailed for sex crimes. The issue didn't receive much support and was dropped.
Shea Alexander, clinical director at Dallas Area Rape Crisis Center, said most offenders typically have more than one victim. She said those who start off with fondling often can go on to commit a sexual assault.
"That's a mental disease that these people have," Alexander said. "They're sick in the head, pedophiles. A pedophile is not going to be satisfied focusing on one child."
AGENCIES INVOLVED AFTER SEX ALLEGATIONS
Public records show the following agencies at various times have looked into cases regarding sexual allegations against teachers in the Dallas Indpendent School District:
Dallas ISD police: The school district has its own police force that was created in 2003. It is fully commissioned and handles most criminal incidents on school campuses. It has an agreement with the Dallas Police Department to receive assistance from the city force if needed. Generally, the department handles sex crimes involving students 17 and older. The district also has a child abuse office that is supposed to collect tips of suspected abuse.
Dallas Police Department: The Dallas Police Department investigates sex crimes involving DISD students younger than 17, under a longtime agreement with the school district's police department. The city force also is available to aid Dallas ISD police when it needs assistance. Child Protective Services work with police to investigate allegations against children.
Office of Professional Responsibility: The Office of Professional Responsibility was created in Dallas ISD in 2007 to investigate fraud, waste and abuse in the school district. The department, led by managers with experience as federal investigators, has worked with Dallas ISD police on some cases that have resulted in criminal charges. The office forwards its findings to Superintendent Michael Hinojosa and key staffers.
MANDATORY REPORTING
Mandatory reporters All adults are mandatory reporters under state law. Professionals, such as school employees and doctors, have greater obligations and must report suspected abuse or neglect of a child within 48 hours. The professional must make the report themselves, which can be made to any local or state law enforcement agency or the Department of Family and Protective Services. Individuals who fail to report abuse can face varying degrees of criminal charges, depending on the child's injuries. Typically, failure to report is considered a Class B misdemeanor, punishable by a fine up to $2,000 or up to 180 days in jail, or both.
